New NY Law Brings Clarity to Neighbor Access for Construction & Repairs 🏗️⚖️

New York has updated RPAPL § 881—finally giving property owners clear rules when repairs or construction require access to a neighboring property.

✔ Silence can now count as refusal after 60 days
✔ Courts can issue licenses when access is unreasonably denied
✔ Clear limits on duration, compensation, and insurance coverage
✔ Stronger protections for adjoining property owners

This update replaces decades of uncertainty with structure, fairness, and accountability—benefiting both sides of the property line.

If you own, manage, or develop property in New York, this is a change you should be aware of.
