After a busy couple weeks, some DMV set aside orders (ie. DMV victories) are rolling in. Two DMV Admin Per Se .08 or higher BAC level cases, and one DMV negligent operator hearing.

The first was a .12 blood test case. I won this one based on evidence and due process objections and argument.

The second was a breath test case with a .08/.08 results. I was able to coordinate testimony and corroborating evidence to secure the victory.

The third was a DMV negligent operator suspension where my client's commercial driver license was getting suspended for too many DMV points. Another victory there.

I was able to win all three hearing to avoid DMV driver license suspensions for my clients.

Won a traffic trial, alleged exceeding 100mph. Case completely dismissed. That makes 7 traffic tickets dismissed out of 8 total traffic trials in the past month. Drive safely, don’t speed, but if you do get a ticket, call me. Happy holidays.

I am happy to report that I filed and won a 1473.7 motion for a client resulting in the withdrawal of a felony conviction from 30 years ago. The charge was subsequently dismissed. The motion is based on a prior conviction causing immigration issues (ie. Deportation/denial of citizenship) resulting from a defendant not being informed of the potential immigration consequences of their plea. Often times the immigration consequences Defendants were not informed of at the time of a plea are worse than the court penalties they agreed to. Many don’t learn of the issues until many years later and experience immigration issues despite the U.S.  being the only country they have ever known.

In this particular case, my client’s father was a war refugee  after getting injured fighting along side of United States soldiers combating communism. My client was brought here as a war refugee with his family as a child and given lawful permanent residency.

His childhood was very challengeing and he grew up in poverty. He was convicted of a non-violent felony offense when he was 19 years old. Flash forward 30 years and he worked hard, studied and succeded in a trade, got married and has educated children of his own (including a daughter that is a registered nurse). Suddenly, he found himself facing potential deportation and separation from his family.

Getting his conviction successfully withdrawn and dismissed has now put him one step closer to remaining in the only home he has ever known (the United States) and hopefully becoming a citizen.

Received notice that I won a negligent operator DMV hearing for my class A commercial driver client . My client received notice from the DMV that his class “A” commercial driver license was getting suspended for 6 months based on too many DMV points. A “class A” license suspension would cause him to lose his job. I was able to get the DMV to delay taking any action against his license until we had a DMV hearing to argue his license should not be suspended. The DMV hearing resulted in a “set aside,” meaning the DMV was Not suspending his license as a result of our successful hearing. Happy client who can continue his employment through the holidays and beyond  and continue providing for his family.

Glad to report that I got a mental health diversion motion granted today on a Felony (non-violent) matter. This is a client that was physically and verbally abused as a child, and that continued for years by her ex-partner. This and other issues along the way caused her to suffer from many DSM-V diagnosis that directly effected her state of mind and action that led to this case. She has been getting regular therapy and now medication through the department of mental health, and is in a better place and improving. I am happy that, with her therapy team and her follow through, I was able to get this motion granted so she will then be in a better place and mind-space to gain employment, continue caring for her children, and continue her transition back into contributing member of her community. At the successful conclusion of the diversion period her felony charge will be completely dismissed.
