It is days like this that make me sad.
An elderly gentleman came in because he did not understand the paperwork he signed at a dealership.
He purchased a used truck. The miles were a little high for the price, but nothing exorbitant.
The interest rate was 20%
Shame on them. They took advantage of this man. Over the life of the loan he will pay $72000 for this truck that should cost about 30k.
Shame on that Ford Dealership.

Belmont Shore Rugby Club is nestled in the heart of Long Beach, California. On the field or beach on any given day you will find an eclectic group of kids with the heart and passion for the game of rugby. Rugby is the fastest growing sport in the US, but for Belmont Shore, rugby is a tradition that started way back in 1964. Throughout the years our men's club has established themselves as being one of the most prominent club's in the US, winning back to back National Championships year after year. We have had many players from around the world, especially New Zealand, play for Belmont Shore. But one thing that we pride ourselves on is how we have adopted the New Zealand style rugby that continues to be present in our youth, as our Kiwi Belmont Shore Alumni coaches give back. As with any growing club, Belmont Shore has invested their efforts in the youth and has grown to be the largest rugby club in the US with over 400 players in the youth program and still growing. As the only rugby club in all of Long Beach, many of our players have fell in love with rugby as there is a position for everyone no matter your size. The teamwork, respect, discipline, and communication that rugby offers to a player goes beyond the field and transfers into school, life and family. We pride ourselves on the rugby culture and embrace it wholeheartedly. We are so honored, blessed, and humbled to be the 1st US team to participate in the New Zealand Junior Rugby Festival, in Taupo, who is celebrating it's 10th year. Here is a classic example of what is wrong with our immigration system in this country.
Client comes in, we file the paperwork, including Form G-28 so the bureaucrats know an attorney is on the case. The check gets cashed August 2d. On 23d October, having heard no response, not even an acknowledgement of the filing (neither me, nor my client), I spend 2 hours on hold with the system to be informed that my G-28 has been rejected. Can you tell me why sir? No.
So, now I will need to arrange a time with my client, so we may sit together for 2 hours on hold, to determine why there has been no progress on the filing.

How do you know if you need to update your will?
If your will leaves everything to your wife, and she is now your x wife, you need to update your will.
If your will mentions your two children, but you really have 5, you need to update your will.
If your will leaves your house in Nashville to your family, but your house is in Columbia, you need to update your will.

I love the practice of law. It is never boring, but sometimes it is crazy. Today, I represented a client who was being sued for back rent, penalties, late fees and court costs. In short order, the plaintiff dismissed his claim and now my client owes nothing. However, a counter claim was filed and the judge denied it. So my client could not recover what he claimed were his losses.
Now, he intends to file a malpractice suit against me. Go figure.

So, no posts here since February. If you are interested, I will be fighting the ACLU on 11 July in the Appellate Court. The issue is whether calling an individual a white supremacist is defamatory.
The next day I start my first jury trial in Rutherford County, depending on tomorrow's Motion.
This Friday I am teaching the local bar association, though it is probably more of a review to most of them.
Next Friday I will be in Hohenwald.
Going to be a busy few weeks. I am sure I will keep you updated every couple of months.
Finally, no ruling from the Supreme Court yet.

Tomorrow is the day. The Supreme Court of Tennessee looms ominously before me. While prepared, it remains a daunting task to argue this case. It is slated for the afternoon docket.

I love this job. You never know what the next call will be. Today, it was the ACLU calling to inform me that they will be filing an appeal against my client from the defamation case. I think it is too late, but that will be a determination for the Appellate Court.

Today's piece of legal advice- free of charge-
When the judge is calling the docket, listen to what he is saying and answer only those questions. This will keep you out of trouble. If you fail in this, do not represent yourself pro se. That is all.

A first for me today. I won a bench trial for a defamation case. It seems that calling someone a white supremacist on Facebook is indeed actionable. Particularly when you do so without a shred of supporting evidence. Glad for the chance to fight back against the individuals that would chill free speech and then hide under the banner of free speech.
