⚖️ MAJOR COURTROOM VICTORY ⚖️
Attorney Barrette's client was charged with second offense Operating While Intoxicated (OWI) and Operating with a Prohibited Alcohol Concentration (PAC). During the trial, Attorney Barrette persuaded the Court to exclude the blood test results, which resulted in the dismissal of the PAC charge. But the State wasn't finished. The prosecution attempted to move forward with the remaining OWI–2nd Offense charge.
Attorney Barrette fought back, arguing that the State had failed to present sufficient evidence to support a conviction. The Court agreed, granting her motion for a directed verdict of acquittal, concluding that no reasonable jury could find her client guilty beyond a reasonable doubt.
🏆 The result? BOTH CHARGES DEFEATED. NO CONVICTION.
This case is a reminder that the prosecution bears the burden of proving every element of a criminal offense beyond a reasonable doubt. When the evidence falls short, a skilled defense attorney knows how to hold the State to that burden.
