October 2 is Wrongful Conviction Day.

Wrongful convictions aren't just something we read about in history books. They have happened here in Florida.

• Florida has had dozens of documented exonerations, including the highest number of death row exonerations in the country.
• James Bain, convicted in Polk County in 1974, spent 35 years in prison before his 2009 exoneration.
• Wrongful convictions can result from a variety of factors, including mistaken identification, false confessions, unreliable forensic evidence, false accusations, and official misconduct.

Today, we recognize those who were wrongfully convicted, those who worked to uncover the truth, and the importance of safeguarding the rights of every person in the criminal justice system.

More Victories Against Protective Orders!

In the past couple of weeks, The Concepcion Law Firm has represented two more individuals against fabricated allegations leading to dismissed protection orders.

In the first, a Risk Protection Order was issued against my client on the flimsiest allegations and the matter was set for hearing - my client didn't even own any weapons! After discussions with the law enforcement agency's general counsel, it was agreed that they had no case and the RPO was dismissed after the Petitioner's voluntary dismissal on the record.

In our second case, an injunction was entered against a minor on flimsy allegations speculated to have been an attempt to get a leg up in a custody matter. Yes, you are remembering correctly - we discussed this sort of thing a few weeks ago. It happens more than anybody wants to recognize. As happened so often, we walked into a hearing where the petitioner parent was completely unable to properly comply with the rules of evidence and family procedure, much less provide competence, substantial evidence to prove their case by preponderance. That matter was also summarily dismissed after the judge heard what little the Petitioner presented.

Don't take protection orders lightly just because they are civil and no jail is involved (unless you violate the injunction). They carry heavy ramifications – especially if there is a companion criminal case or investigation. Lawyer up and always challenge these orders.

CASE DISMISSED! We recently scored a dismissal on a domestic battery case, illustrating why it's so important to always challenge an injunction petition, especially when it's based on false or exaggerated claims in order to gain a leg up in a family case. Double especially when the case is so weak that law enforcement suggested an injunction petition because they couldn't develop probable cause at the time.

In this matter, we challenged the petition, cross-examining the petitioner on their allegations, exposing weaknesses in her case and setting up for testimony to be used against them if a criminal case was ever filed. We want that hearing, with the Injunction being dismissed, but apparently law-enforcement filed an affidavit with the state regardless, and the state file filed the criminal charges months later.

The transcript of that Injunction hearing was instrumental in convincing the state that they had nothing to work with, and should've never filed, resulting in a dismissal. Never roll over on an Injunction!

Cheyenne Alysse Young recently joined The Concepcion Law Firm as my legal assistant and client liaison. We worked together at Leppard Law in Orlando around 2021-2022 when she was interning there before going off to George Mason University Antonio Scalia Law School despite my best attempts to convince her to do something else with her life 🤣. She is currently studying to take the Florida Bar in February and absorbing as much as she can about all aspects of practicing law before she's in a position to go out and represent clients of her own. Welcome Cheyenne!

September is always exciting because that's when I gear up my fall travel season.

However, there have been many other sources of excitement this month. First, Cheyenne Alysse Young, a graduate of GMU Antonin Scalia Law school joined me as a legal assistant / client relations manager / lawyer in training while she studies for the Florida Bar(a more detailed post on that later in the week).

Second, September marks one year since I opened the Wauchula office. It was a scary, big step - especially as I was rebuilding the firm after some difficulties in late 24 - but one that has turned out to be one of the better decisions I've made over the last four years.

Finally, and the most exciting : four years ago, I had to make a snap decision as to whether to find another job or just finally bite the bullet and make the decision I'd been avoiding for the previous couple of years and hang up my own shingle. I decided to be brave and with the support of more people than I can name, got this thing off the ground and managed to keep it going.

Thank you, Cheyenne and Chris for surprising me with a celebration of this anniversary. Thank you to everyone who has supported, helped, or worked with me while on this journey - you all played a part, and I wouldn't be here without you.

Excited as I enter this fifth year of service to my clients as I grow my firm and looking forward to many more.

Ah, traffic tickets.

These are not my bread and butter criminal offenses. These are plain traffic citations filed in the court with TR case numbers assigned. I usually don't get involved in these. The fine is usually much less than what you're gonna pay me and if the officer shows up and is believable, you're out the money you paid me and the money you'll have to pay for the ticket. not to mention, you can probably avoid the adjudication and point yourself by picking the right option.

But sometimes, it's fun to roll the dice. Especially on careless driving cases. The great thing about careless driving is that most times it doesn't matter what the officer has to say. They came after the fact. In Monday's case, my client was alleged to have failed to move over and run an officer off the road then charged with careless driving.

It was so egregious *eye-roll* that the officer didn't even bother writing a report. So when the time came to subpoena witnesses, the only witness is the LEO, who signed the report.

I talked to the LEO like I always do before hearing and realized that there was going to be no witness to the infraction present. Without that, their testimony is hearsay as far as what the other officer would've had to say, and my client's statements were subject to the accident report privilege. With that objection sustained, the LEO had nothing else to provide, and my client was found not guilty.

ANOTHER SUCCESSFUL DOMESTIC VIOLENCE RESOLUTION!


As happens so often - and as you have read in my posts before - it's so common that something gets out of hand at home and results in a 911 call. The end result of that is that the cops get involved; the case drops into the system, and a household is fractured and waiting to see what happens next.

With the victim's cooperation and a proactive client, we were able to convince the state to dismiss these charges before they even made it to arraignment and this is the review I got once it was all said and done. Thanks for the feedback J.P, I try!
