Our client was riding his bike on the Green River Trail on an ordinary spring day. He crashed into a metal bollard in the middle of the path and was left a quadriplegic.

On this episode of the True Claims Podcast, attorney Chris Davis breaks down the six year legal battle that followed. The county argued it was immune from the lawsuit, and the case was dismissed at trial. Chris kept digging. He filed public records requests, pulled old satellite images, and found faded spray paint warnings around the bollard that the county had never disclosed. A former employee confirmed the county knew it was dangerous.

The case went all the way to the Washington State Supreme Court before the county agreed to settle for 10 million dollars.

$10 Million Settlement, Green River Trail Bicycle Accident

In 2017, our client Carl Schwartz was riding on the Green River Trail in Tukwila when he hit an unmarked bollard, one King County had failed to install according to its own safety guidelines. The crash left him quadriplegic.

What followed was a six year legal fight: a dismissal, an appeal, and ultimately a 5-4 Washington Supreme Court ruling that set new precedent for how negligent property owners are held accountable for hidden dangers on their land.

That case resulted in a $10 million settlement for Carl and his wife Sherry, who became his full-time caretaker throughout.

No settlement undoes what happened. But it gives the Schwartz family the ability to move forward on their own terms.

Barbara Hamilton teaches family consumer sciences, health, and senior transitions courses at Reardan High School and Reardan Middle School in the Reardan School District. She covers everything from textiles and nutrition to career and college prep, teaching students in grades seven through twelve.

Barbara was nominated for Teacher of the Month by a coworker. She had no idea she was nominated.

Her classroom needs are wide ranging. She teaches a food and nutrition course where students cook weekly, and her classroom freezer recently broke, causing her to lose all of her food supplies. She also runs a textiles course and advises the school’s FCCLA club, which travels to a national conference each year.

Barbara also spends her own money creating a calming space in her classroom, including a color wall, board games, and card games, so students have somewhere to decompress during the school day.

She’s using her $1,000 gift card toward classroom essentials, food and kitchen supplies, a replacement freezer, and textile tools that help her students, including those with special needs, participate more easily in class.

People sometimes tell us the bollard was “obviously there” and our client didn’t have a real case. Here’s why they’re wrong.

In 2017, Carl Schwartz was riding the Green River Trail in Tukwila when he hit an unmarked bollard head-on. The collision left him with severe, life-changing injuries.

The bollard didn’t meet King County’s own installation guidelines. The yellow paint that should have marked it on the ground was missing. And the bollard itself was white, which is not clearly visible against the Pacific Northwest’s cloudy skies, especially to a cyclist riding at normal speed.

This wasn’t a case of a cyclist not paying attention. It was a hazard the county failed to mark, in violation of its own standards.

The case went all the way to the Washington State Supreme Court, which ruled 5–4 in our client’s favor.

Carl was left permanently disabled. He and his wife, Sherry, had to leave Western Washington to find a home that could accommodate his needs. Sherry became his full-time caretaker for more than six years, until the case finally settled for $10 million.
