With the 75-country ban now in effect, EB-2 visa category finds itself in a very uncertain spot.
While the Visa Bulletin’s Dates for Filing chart is technically current, it appears that this happened because the calculations were done after excluding those 75 countries.
As a result, applicants outside those countries are effectively able to move ahead — which is great if that includes you, but obviously not great if you’re impacted by the ban.
That said, celebrations may be premature. There is substantial litigation underway challenging the ban, and it’s entirely possible it could be overturned in the near future. Because Final Action Dates are still not current for most applicants who became eligible to file in March 2026, a court decision could potentially force those excluded countries back into the numbers. If that happens, we could see priority date retrogression.
If you can move forward on the green card path, do so. Don’t wait unless there’s a clear strategic reason.
At the same time, being able to file now does not automatically mean your green card will arrive sooner. It might — but it also might not. Uncertainty is the theme of the moment.
