Private foundations are generally required to distribute around 5% each year to qualified charities—and it must be properly reported to the IRS.

Missing this requirement can lead to penalties and added compliance issues.

Even with tax-exempt status, strict rules apply, making accurate planning essential.

Have questions about private foundation requirements? Contact Dana Whiting Law to ensure your foundation stays compliant and protected year after year.

A trustee is often required to make outright distributions at specific ages, unless the assets are designed to remain in trust for the beneficiary’s lifetime.

In some cases, especially when a beneficiary’s inheritance exceeds $1 million, it may be appropriate to place those assets into a separate subtrust. This can help protect the inheritance from creditors, lawsuits, and other financial risks.

At Dana Whiting Law, we design trusts with flexibility in mind. That can mean more structure when beneficiaries are younger and gradually more freedom as they mature. Each trust is custom designed to fit your family’s goals and the unique needs of each beneficiary.

Call today to explore your options and create a plan that protects your legacy.
