The latest FTC action involves Rollins, Inc., one of the largest pest control companies in the U.S. Rollins had noncompete agreements that prohibited employees from working in pest control within a predetermined distance.

Under the proposed FTC order, Rollins must, among other obligations, stop enforcing noncompete agreements against thousands of current and former workers.

The FTC’s action against Rollins is a reminder that noncompete agreements are against the law, and that the FTC is paying attention.

The NCAA filed a lawsuit against DraftKings alleging trademark infringement, false association, and dilution over the sportsbook’s unauthorized use of "March Madness," "Final Four," and other branding in its marketing. The lawsuit seeks to stop DraftKings from using these terms during the tournament, citing a need to protect student-athletes and maintain a distance from the gambling industry. DraftKings claims that its usage is protected under the First Amendment as "fair use" for identifying the tournament, similar to how they describe other sporting events.

The MLB's monopoly status dates back to a 1922 Supreme Court ruling that deemed baseball a local business, not interstate commerce. This exemption allows MLB to restrict rival leagues, control franchise locations, and manage player contracts without violating antitrust regulations.

The Supreme Court has repeatedly upheld this designation and many legal experts predict the court will not overturn this precedent.
