EPRA attorneys Kristin Massee and Gary Tiller recently obtained an excellent result in a personal injury jury trial in Chatham County State Court. General liability was admitted before trial, therefore the issues at trial were allocation of fault among the named Defendant and the John Doe Defendant as well as Plaintiff’s damages. Counsel for the John Doe Defendant argued that fault should lie with the client of EPRA, and Plaintiff asked the jury to award damages in the range of $150,000 to $250,000.

The jury deliberated one hour and returned a verdict of just $30,000, allocating 70% of the fault to the John Doe Defendant, and only 30% of the fault to Kristin’s and Gary’s client. This was an outstanding result for our client thanks to the excellent trial work of Kristin and Gary!

EPRA partner, Quentin Marlin, successfully obtained a defense verdict on January 16th following a three-day personal injury trial in Emanuel County Superior Court. The jury returned its verdict in favor of Quentin's client following only twenty minutes of deliberation, bringing a successful conclusion to the case after nearly two years of litigation. Congratulations to our client, staff and Quentin on a job well done!

Tracy O’Connell and Philip Thompson of EPRA secured a victory for Colonial Oil Industries, Inc. before Georgia’s highest court in a decision that will bring certainty to creditors and debtors across the state and validate the rights of parties across the state to freely negotiate binding contracts. Colonial Oil Industries, Inc. sued Lynchar, Inc. d/b/a T & W Oil Company and certain guarantors, alleging breach of an agreement whereby Colonial supplied fuel products and other goods to Lynchar and accompanying guaranties. The trial court found in Colonial’s favor on the breach of contract claims in the case, but the Court of Appeals reversed that decision as to the guarantors, holding that the guaranties were invalid because they did not list Lynchar’s full name in identifying the principal debtor. In a unanimous decision, the Georgia Supreme Court restored the judgment in Colonial’s favor. The Court held that identification of a principal debtor in a guaranty by its trade name is sufficient to render the guaranty enforceable and overruled precedent suggesting otherwise. Tracy O’Connell argued the case before the Court, and Philip Thompson briefed the matter.

EPRA is proud to congratulate Lindsay Sutcliffe on receiving the South Carolina Bar Young Lawyer Division’s “Star of the Quarter” award. This award is in recognition of Lindsay’s pivotal role in helping to conceptualize, plan, and implement a co****le tournament supporting the Make-A-Wish South Carolina Foundation. This event was part of the South Carolina Bar’s Community Bar week, a time when young lawyers come together to serve the community.
Lindsay is a Hilton Head Island native and is licensed to practice in Georgia and South Carolina. Lindsay practices commercial law and estate planning for EPRA as an associate in the firm’s transactional department. However, her wide-ranging experience includes areas such as business formation, commercial real estate closings, employment agreements and trust and estate administration. In addition to her work for the firm, Lindsay was recently appointed Public Relations Director for the Bluffton Rotary group.
We are proud of Lindsay for her exceptional work and the strides she is making, both for the firm and for the community-at-large.
