Can you be ordered to pay the other side’s attorney’s fees in a Georgia family law case?

In some cases, yes.

Unnecessary conflict, refusing to cooperate, or fighting over every issue can make an already expensive case even more costly.

Good strategy means knowing what is worth fighting for.

You can't tell a parent where they're allowed to live. But if the move would materially impact your child or significantly interfere with your ability to maintain a meaningful relationship with them, you may have grounds to ask the court to modify custody or parenting time.

Every relocation case is fact-specific, and timing matters.

Are you seeking sole custody of your child? That might be harder to get than you think.

Courts generally want children to have a relationship with both parents. Therefore, the legal burden to obtain sole custody is very high.

If you believe sole custody is necessary, saying the other parent is unstable or unsafe may not be enough. You need evidence that supports your concerns and a clear plan for your child.

In custody cases, it is not just about what you say. It is about what you can show.

Your parenting plan should not only sound fair in a conference room.

It should work when a child wakes up sick at 6:30 on a Tuesday morning.

Who handles school drop-off?

Who schedules appointments?

How are activities, homework, transportation, expenses, and last-minute changes handled?

A strong parenting plan accounts for ordinary life, not just holidays and summer vacation.

Before agreeing to a plan, ask one question: Could we realistically follow this on a random Tuesday?

Being flexible is not the same as trying to be the favorite parent.

Letting children avoid parenting time, skipping discipline, buying affection, or criticizing the other parent may make you popular temporarily. It does not make you the more stable parent.

Children need structure, consistency, and adults willing to make adult decisions - that's what the judge is looking for.

Dads, you want to hear this.

In Georgia, if you were not married to your child’s mother when your child was born, being listed on the birth certificate does not automatically give you enforceable custody or visitation rights.

Paternity and legitimacy are not the same thing.

You can love your child, support your child, and be present every day while still needing to take legal action to protect your relationship.

Do not assume your rights are secure because your name appears on a document from the hospital.

One of the biggest misconceptions about divorce is that choosing a peaceful approach means you're giving up or being weak - it doesn't.

Being amicable doesn't mean accepting an unfair settlement. It doesn't mean staying quiet. And it definitely doesn't mean you stop protecting your rights.

Some of the strongest legal strategies involve reducing unnecessary conflict while staying laser-focused on what actually matters: your children, your finances, and your future.

As a Certified Amicable Divorce Professional, Casey helps clients understand when negotiation is the smartest path forward and when it's time to fight.
