A case we covered on Litigious has been dismissed: a federal court in Minnesota has dismissed former NFL player Matt Kalil's invasion of privacy lawsuit against his ex-wife Haley Kalil stemming from her comments about their intimate relationship (and his anatomy) on a podcast. Minnesota, unlike New York, recognizes a claim for invasion of privacy based on the "publication of private facts" but only if the disclosure would be "highly offensive to a reasonable person" AND is not on a matter of "legitimate" public concern. Here, the court agreed the disclosure was offensive, but that Haley Kalil's discussion of her own marriage and experience was a legitimate public concern given the parties' celebrity and the fact that she was speaking about her own life. An interesting case in the era of social media and podcast oversharing.

A judge has dismissed Matt Kalil’s lawsuit against his ex wife Haley Kalil. The judge ruled Thursday that comments Haley made about her ex-husband on a November 2025 Twitch stream, including comments regarding his p***s size, were of ‘legitimate public concern.’

A new Litigious is live! We talk about:

- Developments in the Cornell case: NY aims to address the voluntary intoxication loophole; AG James is named special prosecutor but is challenged; how online discourse is going off the rails

[correction from the pod: it’s defendants Lopes and Lee who are asking to have the AG removed, not Kretzachmar]

- Fraternities are in the hot seat: hazing continues to be an issue but has been scrutinized from both a cultural and legal perspective; is the Cornell case an opportunity to give the same attention to what many allege is a culture of sexual assault?

- An NYT article exposes an alleged network of Hollywood heavy hitters hired to smear the reputations of prominent figures’ enemies; how this relates back to the Alexander brothers (Litigious Ep 50) and the Blake Lively case.

The Cornell case has brought awareness to the voluntary intoxication loophole in NY's penal law, one of the reasons the DA said he did not further investigate the victim's complaint. So, where is the gap in the law? S*x offenses under the penal law require lack of consent. One of the definitions of lack of consent is "incapacity to consent." And, in turn, one of the definitions of being "incapable of consent" is being "mentally incapacitated". This is where the loophole comes in: the definition of mental incapacity is being "incapable of appraising or controlling your conduct" due to being administered drugs or another intoxicating substance without your consent. So, if you consumed a substance voluntarily but are still otherwise mentally incapacitated, we have a loophole where the only difference is the voluntariness of the consumption. That is wrong and that is what lawmakers are seeking to address.

The governor vowed to work with lawmakers to remove a defense that can make it harder to prosecute r**e when victims voluntarily consumed drugs or alcohol.

[Content warning: sexual assault]. On today’s episode of Litigious, we discuss the disturbing allegations of r**e at a fraternity house at Cornell University. We talk about:
- why the Tompkins County DA says he failed to investigate the complaint; what this exposes about gaps in communication with the university police as well as NY’s voluntary intoxication loophole
- how civil lawsuits can be used as a tool when the criminal justice system or the Title IX process have failed you
- what are the claims in the civil suit and the potential legal hurdles along the way
- can we hold bystanders accountable?
- problems with how the DA, the college and an attorney for one of the accused have handled this case in the media; are they failing to read the room in 2026? How can you defend yourself or your client without crossing the line into victim shaming?

“How can I help?”

This October, local businesses are answering that question.

Hosting events. Giving a portion of their sales. Inviting their customers into the conversation.

That’s Wellspring’s ONE Campaign: one person, one action, one conversation at a time.

During Relationship Abuse Awareness Month, find something on our calendar you’d enjoy. Bring a friend. Support a local business. And show people affected by abuse that their community cares.

On the 25th anniversary of September 11, we remember those who lost their lives and honor all who continue to be impacted including who suffer from 9/11 related illnesses. Yesterday, New York passed legislation extending deadlines for victims, responders and family members to submit certain claims for retirement, disability and workers’ compensation benefits and, last year, regulations were finalized under NY’s 9/11 Notice Act, which requires employers located in the vicinity of Ground Zero to notify their employees of their eligibility for benefits under state and federal law if they were working during a certain period after 9/11 (a law necessary due to the fact that benefits are not only available to first responders, a common misconception).

2,977 lights rose above New York Harbor in remembrance of the lives lost on September 11, honoring the Twin Towers at full architectural scale, with one light representing each life lost.

Designed in collaboration with voices from the 9/11 family, survivor, and responder community, the commemorative public art installation was unveiled over New York Harbor on Wednesday, September 9. The gathering created a powerful moment of reflection, remembrance, and unity.

IDEKO was honored to support this meaningful production, leading federal and city permitting, safety, and security operations in partnership with Sky Elements Drone Shows and the New York Foundation for the Arts. We would also like to thank the men and women of the FAA, the UCSG, the NYPD, and all the City Agencies who supported this shared moment of remembrance.

“The story of women’s struggle for equality belongs to no single feminist, nor to any one organization but to the collective efforts of all who care about human rights." RIP Gloria Steinem 💙

At a time when women were largely limited to domestic roles, Steinem challenged gender stereotypes and championed feminist ideals like equality, sisterhood and reproductive freedom.
