As most of you probably know by now my wife and partner at the firm Betsy Young is running for State Attorney. She is planning to bring accountability, fairness, and ethics back to the State Attorney’s Office. The current State Attorney has been a disaster for our circuit. My wife will change all of that and bring the same dedication to that office as she has to our firm. We would really appreciate the support of all of you who follow this page and our firm. This is the 18th circuit, however all of this applies here as well. We in the 12th are still in phase 1. Civil jury trials have already been suspended until 2021. I don’t think criminal trials will be to far behind.

Many fear the worst as courts revert to phase 1 and jury trials are again delayed. Layoffs, furloughs and backlogs of cases are only some of the concerns.

This entrapment happens in a large number of these cases. Hopefully law enforcement and the state attorney will stop turning people into criminals otherwise more and more of these will be getting overturned.

The Florida Second District Court of Appeals reversed the trial court’s ruling and said the defendant was entrapped by law enforcement.

We've been getting a lot of questions lately about how to deal with parenting plans and time sharing during the pandemic. Here is a link to the Administrative Order just issued by the chief judge for our circuit. Essentially all parenting plans remain in effect and the courts are not going to allow people to use it as an excuse to not comply. Read it and be informed.

Anyone who is arrested on a misdemeanor violation of the coronavirus quarantine will be held without bond at the jails in Pinellas and Pasco counties, according to an administrative order signed by Anthony Rondolino, chief judge of the Sixth Judicial Circuit, on March 27, 2020. Judge Rondolino’s order comes after the Florida Supreme Court instructed all judges in the state to take judicial steps related to any violation of orders governing quarantine or isolation, limits on travel, the closures of public and private buildings, and curfews, that have been put into effect after the governor declared a statewide public health emergency at the beginning of this month.
“To grant release on bail to persons isolated and detained on a quarantine order because they have a contagious disease which makes them dangerous to others, or to the public in general, would render quarantine laws and regulations nugatory and of no avail,” Judge Rondolino’s order states, quoting precedent.
The order applies to anyone who has violated Florida statute 381.00315, who is “reasonably believed to be infected” with the coronavirus or who is “reasonably believed to have been exposed” to it.
The arresting officer is to notify the jail that the person is or could be infected before bringing them to the jail. The booking staff will then take appropriate measures to ensure the defendant doesn’t transmit the virus to anyone else at the jail while incarcerated. Judge Rondolino’s order, however, does not stop the judge before whom the defendant first appears following their arrest from modifying the no-bond status or addressing the situation in some other way.
I’ll try this next time. But probably get the same answer from the judge.

Federal prosecutors accused Roberta Guedes of aggravated identity theft and mail fraud related to the establishment of what they say were two bogus law firms. Guedes agreed to plead guilty last month.

Florida lawmakers filed a boatload of bills in the last legislative session, more than 3,500 of them in 2019. Even so, only about 200 made it through both the House and Senate before the legislature called it quits in early May.

People often ask me how I can be a defense attorney and defend “those people”. This is why. Imagine being a decorated veteran and falsely accused by police, charged by prosecutors, and sit in jail for nearly a year for a crime you didn’t commit and the only person who believes in you and fights for you is your defense attorney. This can happen to anyone. And when it does you will pray for a defense attorney to be by your side. It is a noble profession that upholds our constitution.
