Here are 4 mistakes that lead to wrongful VA denials:

➡️ The VA didn't do its job. The VA is legally required to help gather your evidence. Missed records or skipped exams can lead to a denial that never should have happened.

C&P examinations often times stem from third party medical providers improperly reviewing records or lazily examining veterans. These bad exams lead to wrongful denials. We need to look at them. We have VBMS access to VA files.

➡️ GI Bill: covers tuition, housing, and training costs, available to veterans and some dependents, though it requires monthly enrollment verification.

Not every VA disability claim is treated the same way. Some conditions get a presumptive connection to your service. Others require you to prove it yourself. Knowing which category your claim falls into changes your entire strategy. ⚖️

Here's the difference:

➡️ What does "presumptive" mean? The VA assumes your condition is connected to your service. No proof of how it happened is required. You only need qualifying service and a current diagnosis.
➡️ Presumptive categories under the PACT Act: burn pit and airborne hazard exposure, Agent Orange, and radiation exposure. Over 330 conditions are now covered nationwide under these presumptions.
➡️ What non-presumptive requires: medical evidence linking your condition to your service, a nexus letter from a doctor, and a higher burden of proof on you to establish the connection.

If your condition falls under a presumptive category, your VA disability claim may move faster and require less evidence upfront. If it doesn't, a strong nexus letter and detailed medical documentation become critical to winning your case.
