It is truly heartbreaking to look someone in the eyes and say that their deceased loved one is only worth $250,000. MICRA states that the general damages (pain and suffering) for medical malpractice is capped at $250,000. Simply, a human life taken by the negligence of a medical provider is only worth $250,000. This law was enacted in 1975, approximately 44 years ago. To put this in perspective, this was the same year that the Vietnam War ended, the movie Jaws was released and a gallon of gas was only 44 cents. We have limited victims of medical malpractice to a specific dollar amount that was created in 1975. It is time to change the law. Be on the lookout for the Prop in the 2020 election and vote yes to change.

CHAMBERS & NORONHA Trial Attorneys, Chantell and Garrett, got justice for our client in Orange County last Friday. Defendants fought liability for almost a year and actually alleged that Plaintiff ran the red light despite two (2) independent witnesses stating otherwise. A few months prior to trial, Defendants admitted liability in hopes of gaining credibility with the jury.

The defense’s position was that the collision didn’t cause the shoulder pain and that it was a pre-existing condition. Notably, Plaintiff had shoulder complaints within the two (2) months before the collision. Garrett and Chantell took and defended numerous depositions to confirm that the collision caused the aggravation of pain to their client’s shoulder. On the eve of trial, the defense conceded causation and the only issue for the jury was damages.

While the Plaintiff visited her primary care physician, numerous physical therapy appointments, and underwent a left arthroscopic shoulder surgery, Plaintiff decided to waive her medical bills and try the case on general damages.

During closing, the defense recommended that the jury award Plaintiff a nominal amount, $5,000, because the surgery wasn’t necessary, and all the pain was caused by her pre-existing condition. Ultimately, the jury awarded 2.5 times the last offer and almost 14 times the defense’s recommended amount in closing.

After almost 3 years, Chantell and Garrett got justice for our client in San Bernardino last week. The Jury gave over $158K reasons why a person should look over their shoulder when merging (Defendants' last offer was $20K). It was a tough motorcycle case where the defense fought tooth and nail on liability.

The defense never changed their position of contesting any liability throughout the remainder of the case.

Chantell and Garrett split the case down the middle. They took turns with taking witnesses. Plaintiff’s experts were Dr. Wagner (Retain non-treating) and Landerville (Ax Recon). Landerville did a great job and boiled it down to common sense. The defense had Grogan (Billing) and Solomon (Ax Recon).

Chantell did an amazing job. Fresh out of TLC, she put everything into action and told the story of the collision in 1st person through the Defendant’s side mirror during closing.

Defense stuck to their guns and told the jury to answer “NO” on question 1 – liability because it was entirely Plaintiff's fault. Garrett did the rebuttal and reiterated that Defendant taking no responsibility was un-American.

Ultimately, the jury saw through the smoke and mirrors and did the right thing. Another win for the good guys!
