Here’s the truth: Under California law, this isn’t necessary! The standard is simply that the defendant’s actions contributed to the harm. There’s no need for extra hurdles.

Case in Point: In Uriell v. Regents of the University of California (2015), the court confirmed that the CACI No. 430 instruction on causation is clear and applies directly to medical malpractice cases.
If you’re dealing with a medical malpractice case, don’t let the defense fool the jury with these tricky instructions. Stick to CACI No. 430 and ensure the jury understands the proper standard of causation!
