CHILD SUPPORT and SOCIAL SECURITY:

Social Security benefits of all types are included in the definition of income for child-support purposes.
This rule applies even when the benefits are dependent benefits payable on account of the children.

If the children's dependent benefits are made payable to the “custodial” parent, the paying parent receives dollar-for-dollar credit against the child-support obligation, and if there is any remainder, is responsible for making up the difference. There is no entitlement to a refund if the benefit payments are larger than the child-support obligation.

Dependent benefits under retirement or SSDI, by contrast, are payable because of a relationship to a person who made sufficient contributions to qualify.These are included in the parent's income and credited against the support obligation.
