We were recently determined by the Circuit Court to be entitled to an award of attorney’s fees in a trip and fall case because the insurance company for the defendant decided to “roll the dice”and reject our proposal for settlement (PFS). We offered to settle a case for the $100,000 insurance policy limits way back in 2018, but the defendant’s insurance company rejected our offer. We received a jury verdict greatly in excess of $100,000 and moved for an award of fees under Rule 1.525 Fla. R. Civ. P. within 30 days of the verdict. The insurance company appealed the verdict and lost. Now it owes our attorney’s fees and costs from the date of our 2018 PFS, plus interest from the date the court determined entitlement in October, 2023 pursuant to Quality Engineered Installation, Inc. v. Higley South, Inc., 670 So.2d 929 (Fla. 1996). We did a lot of work on the case over 8 years, including two trials, one of which was declared a mistrial due to errors attributed to the defense.

It took a long time, in the end justice prevailed.

Kudos to Scott Herring for his hard work in resolving a pickup truck crash claim on behalf of one of our clients. On the eve of trial in Lake County he settled the case for $980,000.

Happy to have settled a low impact car crash personal injury claim for one of our clients in mediation for $175,000. The highest pre-mediation offer had been $40,000.
