Should children be allowed to testify in a divorce?

In Utah, children rarely speak directly to a judge. Instead, the court relies on a Guardian ad Litem, an attorney appointed to represent the child’s best interests. However, there is a push to allow these attorneys to represent exactly what the child wants, rather than just what the attorney believes is best. While Utah law says judges will listen to children once they turn 14, there is no clear process for how that happens without putting kids in the middle of a courtroom battle.

Is the family court system rigged against men?

Courts divide assets equitably to ensure fairness. In Utah, that does not automatically mean an even split, and it is not based on gender.

When one spouse sacrifices their education and career to raise children, their financial standing changes. When the other spouse focuses on work, their earning power grows. Divorce forces both people to make difficult financial sacrifices and start over. It is a legal restructuring of a shared life, not a payout.
