“Your Social Security Hearing”

Your Social Security Hearing will be conducted at the Social Security Office, which is typically in Huntington, West Virginia, for claims that are filed in this area. The judge will look into the issues at your hearing, and often will have questions for the claimant and other witnesses. The Judge will also look at any evidence to support the claim.

A Social Security Disability hearing is private, and is typically attended only by the Administrative Law Judge, the claimant, the claimant’s attorney, a vocational-expert, and a stenographer. The claimant is usually questioned first. The Judge may conduct extensive examination of the claimant and then allow the claimant’s attorney to ask questions. This is why it is very important to be prepared for your hearing.

After the claimant testifies, the Judge will then question the vocational-expert regarding the physical and mental impairments of the claimant and whether there are jobs that exist in the national and local economies that the claimant can perform. Your attorney then has the opportunity to cross examine the vocational-expert.
As in any disability case, the issue is whether or not the claimant is totally and permanently disabled in light of his or her age, education, and work experience.

Following the hearing, the Judge will issue a decision. Getting a decision from the Judge is often a very long process which can take several months. It is very important for the claimant to keep the attorney advised of all medical treatment so that all medical records may be submitted into evidence prior to the hearing. Most Social Security hearings last on average about an hour.

"The New Felony Expungement Law Takes Effect"

Statistics indicate that one in three Americans has a criminal record, which can have grave consequences on employment, housing, and even education. The KY Legislature has addressed this issue with the passage of House Bill 40, which now creates a process to expunge 61 Class D felonies, including possession of a controlled substance, possession of a forged instrument, theft by unlawful taking, criminal mischief, tampering with physical evidence, burglary in the third degree, and others. This list covers 60-70% of Class D felonies. This new law went into effect on July 15, 2016.

House Bill 40 also made changes to the misdemeanor expungement process. Under the old law, a person seeking expungement was required to have a clear criminal record in the five years prior to the conviction they were trying to expunge; the new law simply requires that the person have a clear record for the five years before filing for expungement.

The Kentucky Chamber of Commerce was a key supporter of the new felony expungement, with the view that felony conviction can keep many people out of work. Under the new law, the conviction is removed from the criminal record in the state system.
