TRICK or TRUTH? If police don’t read you your Miranda rights, does your case automatically get thrown out?

Not exactly. In Ohio, Miranda warnings are generally required when someone is both in police custody and being questioned by law enforcement about a crime. Simply being arrested doesn’t automatically trigger the requirement.

If police conduct a custodial interrogation without the required warnings, statements made during that questioning may be excluded from evidence. However, that doesn’t automatically mean the charges are dropped or the entire case is dismissed.

The details matter, and the outcome depends on the circumstances.

What you tell AI may not be as private as you think.

According to reports, Anthropic, the company behind Claude AI, flagged messages containing alleged threats against the Lee County Sheriff's Office and reported them to law enforcement. A Florida woman was subsequently arrested.

The case raises an important question: When you share something with an AI chatbot, who else might see it?

AI privacy policies matter. Before treating a chatbot like a private diary, understand how your conversations may be reviewed or shared.

So what CAN police ask you? And what CAN you refuse to answer?

Under Ohio’s new law, if an officer reasonably suspects a driver or passenger committed a motor-vehicle violation, they can require you to provide your name, address, and date of birth.

They can also ask you other questions, but you are not required under this law to answer those additional questions. In other words, questions like “Where are you going?” “Where are you coming from?” or “Do you know why I pulled you over?” are not part of the information this law requires you to provide.

The key distinction: you must provide your name, address, and date of birth when the law applies, but you do not have to answer additional questions under this law.

There is a specific exception when age is an element of the offense you’re suspected of committing.

Refusing to provide information the law requires can be a 4th-degree misdemeanor.

Ohio is generally a one-party consent state. If you’re part of the conversation, you can generally record it without telling the other person.

Why generally? Ohio law makes an exception when the recording is made for the purpose of committing a crime, tort, or other injurious act.

Over the last six months, attorney Alonda Bush has secured dismissals in courts across Ohio — including cases involving accidents, serious felony allegations, protection orders, and matters where a dismissal was far from a given.

In one case, Alonda was the second attorney for the client, as prior counsel was unable to achieve the client’s desired dismissal. In another, an F1 charge was dismissed with prejudice. Other matters required challenging whether the proper information had been provided, examining the circumstances surrounding an accident, or simply continuing to push the case forward.

Different courts. Different charges. Different circumstances.

The common thread: 28 matters fully dismissed since March.
