This is John Riley Ross, the founder of Ross Patent Law Office and one of its two attorneys. ⁣

Mr. Ross grew up, met his wife, and obtained a Nuclear Engineering degree all in his home state of North Carolina. Following his graduation, Mr. Ross moved with his wife Sallie to Pittsburgh, Pennsylvania to obtain a JD degree in Law from Pittsburgh’s Duquesne University. (Fun Fact: Mr. Ross’s first son, also named John, was born during this time and has been an attorney for Ross Patent Law Office since 1996)⁣

Mr. Ross moved to Del Mar, California with his wife and three children in 1974, started Ross Patent Law Office in 1984, and has been a practicing attorney with this firm ever since.⁣

Trademarks:

A trademark identifies and distinguishes the source of the goods (or services) of one party from those of another.

The strongest type of trademark is referred to as a “fanciful” trademark. For example, a fanciful trademark has no logical meaning, such as “Kodak” to refer to photography equipment or “Adidas” to refer to athletic gear. The words “Kodak” and “Adidas” have no true meaning other than to function as the source indicator of the goods being sold.

Trademark owners should take care that their trademarks do not become “generic” because protection may be lost for the mark. A generic term is the common name for the product or service. For example, the term “baseball bat” is a generic term that refers to a baseball bat or “soccer ball” is a generic term that refers to a soccer ball. Examples of trademarks that have become or that are in danger of becoming generic include “Kleenex”, “Aspirin” or “Yo-Yo”.
