VAWA, U visas and T visas are sometimes discussed together, but they address different circumstances.

VAWA may provide a pathway for certain survivors of battery or extreme cruelty involving qualifying family relationships.

A U visa may apply to certain victims of qualifying criminal activity who have suffered substantial physical or mental abuse and meet additional requirements.

A T visa may apply to certain survivors of severe forms of human trafficking who meet additional requirements.

A better starting question is not, “Which form should I file?”

It is: “What happened, and which immigration protections may apply to those circumstances?”

A significant change to the public charge framework took effect September 18, 2026.

DHS rescinded the 2022 public charge regulations and revised the public charge bond provisions, restoring broader discretion to immigration officers.

It applies to covered applications for admission and to adjustment of status applications postmarked or submitted on or after that date. Consular immigrant visa cases follow a separate framework.

USCIS also published a revised Form I-485, edition date 09/18/26. What controls is the date a filing is postmarked or submitted, not the date it was prepared.

Not every immigration category is affected the same way.

If you are preparing an adjustment of status application, review the current rules rather than guidance issued under the previous framework.

“Will my abuser find out if I file?”

For someone considering a VAWA self-petition, privacy may be one of the first concerns.

Federal law provides confidentiality protections for VAWA self-petitioners and restricts how protected information may be disclosed. USCIS also has special procedures for people with protected VAWA, T and U cases. These protections are significant, but they are not unlimited. They include exceptions, and they govern what the government may disclose rather than what someone may learn through other sources.

Privacy concerns can also affect practical decisions, including where immigration correspondence should be sent.

What should couples prepare before filing a fiancé petition?

Start by looking beyond Form I-129F.

The petitioner must be a U.S. citizen. Permanent residents cannot file a fiancé petition.

Couples should also consider whether they meet the other K-1 requirements, what evidence can document their relationship, and what steps will follow if the fiancé visa is issued.

K-1 couples generally must intend to marry within 90 days after the fiancé enters the United States. There is also generally an in-person meeting requirement, although limited exceptions may apply.

A fiancé petition is one part of a multi-step process. Preparing for the full process before filing can help identify questions early.
