⚖️ Important Update for Ethiopian TPS Holders

The legal situation surrounding Temporary Protected Status (TPS) for Ethiopia continues to change.

Our latest blog explains the impact of the Supreme Court’s decision in Mullin v. Doe and the First Circuit’s subsequent ruling involving Ethiopia TPS.

Important update since publication: On August 18, a federal judge lifted the administrative stay that had temporarily postponed the termination of Ethiopia’s TPS designation. While litigation remains ongoing, TPS holders should not assume earlier court-ordered protections or extension dates still apply.

⚖️ 5 Signs It May Be Time to Speak with an Immigration Attorney

Not every immigration question requires legal representation. But certain situations may be a sign that it's time to better understand your options.

Consider seeking legal guidance if:

✅ Your case is taking longer than expected.
✅ You've received a Request for Evidence (RFE).
✅ Your family situation has changed.
✅ You're unsure which immigration process applies to you.

👨‍👩‍👧‍👦 Family Petition vs. Adjustment of Status: What's the Difference?

These two terms are often used together, but they aren't the same thing.

A family petition establishes the qualifying relationship between a U.S. citizen or lawful permanent resident and a family member.

Adjustment of Status is the process that may allow an eligible individual already in the United States to apply for lawful permanent residence.

Understanding the difference is an important first step toward making informed decisions about your immigration journey.

Every family's situation is unique, and the right path depends on your individual circumstances.

At Getachew & Ansari, we help families understand the immigration process before they file, so they can move forward with confidence.

Filing for a green card before September 18? You may lock in the current rules.

Applications properly filed before that date stay under the existing public charge framework, even if USCIS decides them next year. File on or after the 18th and officers get much wider latitude to weigh your income, assets, employment history, education, and benefit use.

A sponsor is still required and still matters. What changes is that officers are no longer required to count the affidavit of support in your favor.

There's also a form trap. A new Form I-485 takes over on the 18th, and old editions get rejected and returned. A rejection does not save your original filing date.

Some categories are exempt entirely. Worth checking where you stand before the date passes.

Many people wonder whether their immigration situation is “simple” enough to handle alone.

In reality, immigration law rarely involves just one form. Entry history, family relationships, timing, prior filings, and even small details can affect what options are available and how long a case may take.

Delays and denials often start with misunderstandings at the beginning.
If you are unsure where you stand, getting accurate information before filing anything can save time, stress, and unnecessary expense.

Getachew & Ansari Immigration Attorneys, P.C. is based in San Jose and assists individuals and families across the United States and around the world.

08/13/2026

Recent USCIS policy changes place greater emphasis on individualized review. Officers are expected to carefully evaluate the evidence in each case and explain the reasoning behind their decisions.

That means a well-prepared application is about much more than submitting the required forms.

Supporting documentation, your personal history, evidence that addresses your specific circumstances, and an overall legal strategy all play an important role in presenting your case clearly.

Every immigration journey is different. What strengthens one application may not be relevant in another.

At Getachew & Ansari Immigration Attorneys, P.C., we take the time to understand your situation, identify the evidence that supports your case, and prepare applications thoughtfully and thoroughly.

If you're considering filing for Adjustment of Status or already planning your application, experienced legal guidance can help you move forward with greater clarity and confidence.
