The Supreme Court listened to arguments today on Trump’s executive order that would restrict birthright citizenship to only those with at least one parent who has a green card or U.S. citizenship. Immigration attorney Andrew Newcomb talks about how this violates the 14th Amendment and over 100 years of precedent, and how even conservative justices appointed by Trump—including Brett Kavanaugh, John Roberts, and Amy Coney Barrett—appeared highly skeptical of the policy, questioning its implementation and constitutionality. DOJ Admits Mistake: ICE Enforcement at Immigration Courts Ruled Unconstitutional

Immigration attorney discusses how lawyers for the Department of Justice admitted that they made a mistake by relying on an ICE memo to defend enforcement operations at immigration courts. The memo never actually applied to civil immigration enforcement at or near immigration courts. This admission follows a December 26, 2025 federal court decision by Judge Pitts that prevented ICE from conducting enforcement actions at immigration courts in the Northern District of California. Judge Pitts ruled that forcing immigrants to choose between showing up to court and risking arrest or not showing up and facing removal was unconstitutional. We explore how the federal judiciary is working to prevent overreach by ICE.
