Most business owners have heard the term "antitrust," but couldn't tell you exactly what it means for them. Enter, The Sherman Act.

It does two main things: it prohibits agreements that unreasonably restrain trade, and it prohibits monopolization or attempts to monopolize a market. That means price-fixing agreements with competitors, dividing up markets or customers, "all-or-nothing" contracts that squeeze out rivals, and using dominant market position to crush competition can all land a business in serious legal trouble.

Gaw | Poe LLP is thrilled to announce the hiring of Mr. Paul Martin, who will be joining us as a Senior Associate.

A graduate of Yale Law School in 2020, Paul's experience ranges from multidistrict litigation to high-stakes appeals in the United States Court of Appeals for the Ninth Circuit and the California Courts of Appeal. He has represented numerous clients in the technology, entertainment, and education sectors.

Prior to joining Gaw | Poe LLP, Mr. Martin clerked for Judge Hernán Vera of the United States District Court for the Central District of California and spent more than four years as a litigation associate at Munger, Tolles & Olson.

Outside of Gaw | Poe, Paul has accomplished walking 500 miles on the historic Camino de Santiago in Spain. He also occasionally publishes short stories and translations.

Gaw | Poe LLP is pleased to announce an appellate victory in a price discrimination lawsuit brought against the manufacturers of the Clear Eyes product.

In addition to affirming our trial victory, the appellate court agreed that the District Court abused its discretion by reducing our requested attorney fee rates based solely on the fact that we are a four-lawyer firm representing independent “mom-and-pop” warehouses.

Importantly, the Court made clear that the size of a law firm is not a reasonable basis for reducing otherwise reasonable hourly rates.

This decision reinforces a simple but critical principle: excellence in advocacy is not determined by firm size.
