As you might imagine, I'm in favor of struggling tenants calling an attorney. However, some issues can be handled with the assistance of a tenants’ rights organization, a local housing agency, or the free legal consultations offered by some libraries.

Here are a few issues that may fall into this category:

1. Poor Communication: Tenants often struggle with landlords who are difficult to reach or unresponsive. This can make it hard to resolve issues quickly, leading to prolonged problems with maintenance or lease disputes.

2. Security Deposit Disputes: A common issue involves landlords unfairly withholding security deposits at the end of the lease. Tenants often report that landlords fail to provide an itemized list of deductions, or they wrongfully claim damage to the property in order to retain part or all of the deposit.

3. Excessive or Unreasonable Fees: Some landlords impose extra fees that tenants consider unfair, such as fees for late rent payments, additional security deposits for pets, or arbitrary charges for maintenance.

A significant concern for many potential clients is whether they will have to go to court. I get to tell them good news: you won’t necessarily have to!

Many personal injury claims are settled out of court. My goal is always to secure the best outcome for you, whether that’s through a fair settlement or, if necessary, fighting in court.

Either way, like most personal injury attorneys, I work on a contingency fee basis. That means I only get paid if my client wins at their trial or settles their case.

"What should I do after a collision?"

This is a question I still get a lot, so here’s your PSA for the day.

Getting into a car collision can be overwhelming, but the steps you take right after can make a big difference in your case. Here’s what to do:

1. Seek medical attention right away, even if you think you’re okay.

2. Document your injuries and the accident scene with photos and videos.

3. Get contact information from witnesses.

4. Contact an attorney (like me!) to understand your rights. You want an experienced lawyer who can help you get the maximum benefit for your damage claims or defend you if you cause the crash. You want someone familiar with all the personal injury laws in California.

One of the types of clients I’m passionate about helping is tenants who find out they’re renting an illegal unit.

They do still have rights, so here’s what they need to know and do to protect themselves:

1. Know your rights. Even in an illegal rental, tenants often have rights under local, state, and federal laws. These can include the right to a safe and habitable living environment, privacy and protection from retaliation.

2. Is it habitable? The landlord is typically still required to maintain the rental unit in a habitable condition, even if the rental itself is illegal. This means addressing issues like plumbing, heating, electricity, and structural safety.

3. Retaliation is not OK. In many jurisdictions, landlords cannot retaliate against tenants for reporting unsafe conditions or illegal rentals to authorities. This includes protection from eviction, increased rent, or other forms of retaliation.

4. The legal eviction procedure. Landlords must follow legal eviction procedures. If they attempt to evict you without following these procedures, you may have grounds to challenge the eviction in court. So-called self-help evictions — such as changing locks or shutting off utilities — are usually illegal.

5. Security deposit rights. You are entitled to the return of your security deposit minus any lawful deductions for damages or unpaid rent.

I almost always get asking this when meeting with a potential client who has been injured. It’s a common question, and the answer isn’t always straightforward.

Some cases can be settled before a case is even filed with the court, while others require more time and effort to ensure fair compensation. It depends on the complexity of the case, whether the case goes to trial, what county your case is filed in, and the willingness of insurance companies to come to the table and negotiate the case in good faith.
