About Us – Walkup Melodia Kelly & Schoenberger

Established in 1959

For over 50 years, our lawyers have represented individuals throughout California who suffered catastrophic injuries or lost loved ones. News and World Report rated Walkup a “National Top Tier” product liability firm and a “Metropolitan First-Tier” personal injury firm. More than 50% of our attorneys were peer-nominated as Northe

rn California SuperLawyers (fewer than 5% of all lawyers in the state achieve this rating). In 2011, two of our lawyers were listed in the “Top 100” lawyers in the state, one in the “Top 50 Women Lawyers,” and one in the “Top 10.” In recent years, three of our attorneys were named SFTLA “Trial Lawyer of the Year.” Other titles given to our attorneys include “Consumer Attorney of the Year” (awarded by CAOC) and “Best Personal Injury Attorney” (awarded by the San Francisco Recorder). Our lawyers also hold “Best Lawyers in America” listings and Martindale-Hubbell “AV” ratings. Walkup attorneys hold teaching positions at local law schools including Hastings, Berkeley, and USF School of Law. They train other trial lawyers as part of NITA (National Institute for Trial Advocacy), ABOTA, the California Continuing Education of the Bar, and the Rutter Group. They have traveled to Belfast, Mexico, Kosovo, Macedonia, Japan, Britain, Scotland, and Eastern Europe to train lawyers in trial advocacy. They have served as board members, chairpersons, and presidents in leading organizations, including the San Francisco Bar Association, Consumer Attorneys of California, the San Francisco Trial Lawyers Association, ABOTA, the International Society of Barristers, and the San Francisco Bar Association Judiciary Committee. In their spare time, Walkup attorneys give back to the community. They helped establish ABC (Attorneys Bettering the Community) a non-profit for lawyers who want to engage in hands-on service work. They take on pro bono cases; coach youth basketball, high school and law school mock trial teams; work with volunteer programs from the SF Bar Association; and work with the Rule of Law Initiative in developing countries. In Crash Victim v. Estate of Driver (N. Cal. Sup. Ct.), Walkup, Melodia, Kelly + Schoenberger's Kelly Ganci and Doug Saeltzer recovered $1,300,000 on behalf of a client injured in a head-on collision. Our 55-year-old client sustained a traumatic brain injury and multiple spinal fractures. She was hospitalized and required extended rehabilitation. The defendant driver’s insurer promptly tendered its $250,000 policy limit. Doug and Kelly then sought and recovered policy limits under a disputed umbrella policy. New UC Berkeley Law Analysis Confirms Uber Ballot Measure Will Harm Crash Victims, Raise Health Care Costs, and Reduce Access to Justice.

FOR IMMEDIATE RELEASE ([email protected])

SACRAMENTO — A new analysis conducted by the Civil Justice Research Initiative at UC Berkeley School of Law finds that Uber’s proposed ballot initiative would

increase health care costs for people injured in car accidents, significantly reduce access to legal representation for victims, and leave many victims unable to recover any damages at all.

The report, “An Analysis of Uber’s 2026 California Ballot Initiative and its Likely Impacts on Californians Injured in Car Accident Cases,” also concludes that the measure is “likely to be misunderstood by voters” and warns that it could “radically restructure” the civil justice system in ways that benefit corporations at the expense of injured Californians. It also finds: “Many victims will likely receive nothing at all if the initiative is passed.”

The analysis had the following key takeaways:

1) “The proposed initiative is confusing and likely to be misunderstood by voters”

2) “The proposed initiative, if passed, is likely to decrease the availability of legal representation in Consumer Attorneys of California

3)“Restrictions on the recovery of medical expenses will likely result in increased health care costs to state and local governments as well as in higher health care costs for injured individuals.”
