The 14th Amendment to the U.S. Constitution provides that all persons born in the United States are U.S. citizens and entitled to the “privileges and immunities” of citizenship. One of the fundamental privileges of citizenship is the right to obtain a birth certificate. This document is the most basic form of identification (and identity) of any person, of his or her place and date of birth, as well as proof of one’s parents.

In spite of this basic right, the State of Texas has recently instituted an anti-immigrant policy of making it impossible in practice for the U.S.-born children of immigrants – American citizens – to obtain birth certificates.

The Texas Civil Right Project is hoping to put an end to this practice. They have filed a lawsuit against the state’s health services department and its directors challenging their restrictive ID requirements and TDSHS’s practices of denying birth certificates because they violate the 14th Amendment’s Equal Protection and Due Process clauses (Perales Serna et al. v. TDSHS et al., WDTX, 1:15-CV-446).

Please donate to send an experienced legal services team to the largest immigration detention center in the country. For one week in December, they will represent women and children who have fled extreme violence in their home countries in order to seek protection in the United States, but who are instead being jailed unlawfully in a for-profit prison system. The imprisonment of asylum seekers, especially women and children who have no criminal history, is cruel and shameful and does not reflect American values. The good news is the CARA pro bono project - which is dependent on volunteer attorneys across the country- is helping these women and children leave detention and successfully navigate the asylum system.

Over the past decade the female prison population in the United States has continued to grow at an alarming rate. Between 2000 through 2009 the number of women incarcerated in state and federal prisons rose by 22% compared to a 15% increase in the male prison population. While the number of incarcerated men still far exceeds the number of incarcerated women (which was estimated to be ~ 200,000 in 2010) the growth of the female prison population has a distinct effect on families and communities that are torn apart as a result. What’s more, sexual violence, domestic abuse, and poverty are all strongly correlated with women’s incarceration. We are locking up victims and survivors instead of providing them with the treatments and services they need to live healthy and product lives.
