Honoring Our Veterans This Veterans Day
Today, we take a moment to honor and express our gratitude to all those who have served our country, including my father, Ralph Walraven, who served a brief stint in the U.S. Army. At the Law Offices of William Walraven, we are proud to represent Veterans in the criminal justice system.
Many Veterans face unique challenges as they transition back to civilian life. Sometimes, the very experiences gained during their service can lead them into contact with the criminal courts. Recognizing this reality, California has implemented Military Diversion (Penal Code Section 1001.80), a program that acknowledges the profound connection between military service and certain behavioral health challenges, such as PTSD, traumatic brain injury, substance abuse, sexual trauma, and other service-related conditions.
What sets Military Diversion apart is its availability for DUI cases, while standard Misdemeanor Diversion is not. This distinction reflects California’s commitment to providing Veterans with pathways to treatment and rehabilitation rather than solely focusing on punishment.
Upon successfully completing Military Diversion, the criminal case will be dismissed, and the arrest record will be sealed, offering a genuine fresh start.
However, it’s important to note that the procedures, requirements, and implementation of Military Diversion vary across different counties in California. It’s crucial to work with a skilled attorney who has specific knowledge of your county’s process and can effectively guide you through the necessary steps for approval and successful completion.
