A few things you need to know about the Supreme Court's DACA decision published June 18, 2020:

1) The Supreme Court held that the Government's (the Trump Administration) attempt to end DACA was unlawful in violation of the Administrative Procedures Act ("APA"). What does this mean? It means that USCIS policies are to be followed to what they were as though the unlawful policy never existed: meaning that USCIS should begin accepting applications for DACA (initial and renewal) and issue immigration relief. As of this moment, however, USCIS has not posted any information on their website and there is no indication as to how the application process is going to work out.

2) The Supreme Court did not hold that the Trump Administration cannot rescind DACA. It only held that the way in which it tried to do it was unlawful. Was does this also mean? It means that the DHS could potentially attempt to implement a new policy (in compliance with the APA and lawful in other ways) to rid of DACA. If not lawful again, such policies will be the subject of litigation for the foreseeable future, again. At this point, DHS has not provided any information.

3) Lastly, and most importantly, remember that DACA will remain controversial and is not as stable. It creates a second class status for nearly 700,000 human beings. Stay informed and alert!

"The dissent is correct that DACA was rescinded because
of the Attorney General’s illegality determination. See
ante, at 20. But nothing about that determination foreclosed or even addressed the options of retaining forbearance or accommodating particular reliance interests. Acting Secretary Duke should have considered those matters
but did not. That failure was arbitrary and capricious in
violation of the APA."

Time to consider the legal implications...
