"If you're offered severance after any kind of termination, slow down before you sign:

1) Do you understand exactly which legal claims you're giving up?
2) Does the non-disparagement clause try to block you from reporting unlawful conduct? (It legally can't.)
3) Were you given real time to have it reviewed — federal law generally requires at least 21 days for certain releases?
4) Is it in addition to wages/PTO you already earned, or instead of them?

Once you sign a release, you typically can't go back. Have it reviewed first."

"Your employer generally has a legal duty to engage in good faith with you about a reasonable accommodation for a disability or serious health condition — not just deny it and move on.

Warning signs: you're labeled a “liability” after disclosing a health condition, your accommodation request goes nowhere, or you're let go shortly after asking for one.

One of our clients was retaliated against while she was fighting cancer and needed medical leave — the jury didn't just side with her, they sent a message with an eight-figure verdict."

"2026 has brought another wave of Big Tech layoffs. A real reduction-in-force affects a broad group for documented business reasons. But recent lawsuits show what it looks like when age discrimination hides inside a “layoff”: one recent suit against a major tech company alleges workers over 50 were 2.5x more likely to be cut than those under 40. HP paid $18 million and Google paid $11 million to settle similar claims in years past.

If your team's layoff skewed heavily toward one age group, that pattern is worth a second look — not just an HR footnote."

Religious discrimination at work can look like: comments or assumptions tied to your faith, refusal to reasonably accommodate a religious practice or holiday, or discipline that started right after your religion became known to a manager.

In one of our cases, a security guard was called a slur tied to his faith by his own supervisor — a San Francisco jury called it exactly what it was and returned a verdict for our client.

Faith-based bias has no place in any workplace, and the law backs that up.

"Signs of pregnancy or medical-leave discrimination:

1) A job offer or start date gets pulled after you disclose you're pregnant
2) You're terminated during or shortly after FMLA/CFRA leave
3) You're passed over for a promotion you'd already earned, right after returning from leave
4) You're told to “prove” your health needs beyond what the law requires

We've taken on cases exactly like this — including a Marin County jury verdict for a woman whose job offer was pulled the moment she disclosed her pregnancy."

"A hostile work environment isn't just an unpleasant office — it's a legal standard. Racial slurs, symbols of hate, “jokes” that get normalized, and management that looks the other way can all meet that bar.

In one of our cases, a jury found an employer liable after management dismissed a serious complaint as “just a joke” — and then failed to properly investigate it at all.

If HR's response to a serious complaint was to minimize it, that failure to investigate can itself be part of the claim."

"Retaliation doesn't always look like a firing. It can look like:

1) Sudden bad performance reviews after years of good ones
2) Being cut out of meetings or projects
3) A demotion dressed up as a “reorg”
4) Getting managed out over months
5) Isolation from coworkers or sudden schedule changes

If it started after you reported harassment, discrimination, or misconduct, it's worth documenting — and worth a call."

Happy National Son and Daughter Day!
At the Law Offices of Joseph L. Alioto & Angela Alioto, family is at the heart of what we do. Angela is proud to work alongside three of her children—Angela Mia, Joe, and Gian-Paolo—who share the family’s commitment to justice, service, and advocacy.

And while her son Adolfo may not be at the law firm, as a Master Chef, he makes sure the family is always well fed!

Today, we celebrate family, working together, and the special bond between parents and their children.

"Reported financial fraud? Flagged unsafe conditions? Refused to falsify data or ignore a compliance violation?

California and federal law protect employees who report suspected illegal conduct — internally or to a government agency — regardless of job title. We've represented whistleblowers from warehouse workers who exposed insurance fraud to a corporate CFO who refused to look away from wrongdoing.

If you were fired, demoted, or suddenly “restructured out” shortly after speaking up, that timing matters."
