Maybe your company isn’t worth that much yet, so you figure you don’t need a prenup. Or maybe you assume any IP you create is yours as long as you don’t assign it to your employer.

If you’re married in California, the reality might not be what you expect.

Under the state’s community property rules, any compensation you earn during a marriage is considered “community property,” to be split 50/50 if you ever divorce.

This includes all types of Bay Area tech compensation, from founder’s stock to the value of a patent or trademark, goodwill in your name or brand, or a codebase you built.

A company worth very little on your wedding day can be worth a great deal a few years later, and that appreciation gets divided in a divorce… unless you take steps to protect it.

A prenuptial or even postnuptial agreement (sometimes called a transmutation agreement) can put these questions to rest. You and your fiancé or spouse can sort out who gets what, which assets count as community property, and which ones stay separate.

If you’re thinking about becoming a parent through surrogacy, California is an excellent place to do it you don’t even need to live in the state, or in the United States.

California law defines an “intended parent” very broadly.

You can have a surrogate if you’re married, unmarried, partnered, or single.

You can be a same-sex couple or an LGBTQ+ individual.

You don’t need a genetic connection to your child donor eggs, donor s***m, and donated embryos are all accepted.

But there’s a catch. To be protected, your surrogacy agreement must follow the letter and process of the law. Only an experienced attorney can ensure this.

It’s also important to consider your expected timeline. The surrogacy process can take anywhere between 15 and 24 months, and the legal work must be finished before any medical treatments begin.

When you signed a prenup years ago, you figured everything was settled. Property, alimony, who keeps what… all decided long before divorce was ever on the tagble.

So it may surprise you to know that not all prenups can hold up against challenges in court, even if they’ve been in place for a decade or more.

California courts don’t automatically enforce every prenuptial agreement.

If you or your spouse…

Were handed the document at the last minute,

Didn’t ever have your own lawyer, or

Never got a full picture of the other’s finances,

You may have real grounds to challenge the prenup.

And even a properly signed prenup can be set aside if enforcing it today would be unconscionable, or deeply unfair.
