⚖️ Illegal Immigrants Committing Crimes Are the Strongest Opponents of Legal Immigrants

Immigration attorney Deron Smallcomb said it clearly on Fox News:

As somebody who advocates for immigrants on a regular basis — there is no stronger opponent than people coming in illegally and committing crimes and making it look bad for everybody.

Here’s why it matters:

When Tom Homan says he’s going to flood the zone with more ICE agents — those agents don’t just go after criminals. They come after everybody. Including people who are genuinely seeking a lawful pathway to permanent residence or citizenship.

🔹 Illegal immigrants committing crimes give the administration justification for broader enforcement
🔹 That enforcement hits everyone — including legal immigration seekers trying to do it right
🔹 The people following the rules pay the price for those who don’t

The people doing it right deserve better 🙏

⚖️ Sanctuary Cities Cater to Criminals — And Legal Immigrants Pay the Price

Immigration attorney Deron Smallcomb on Fox News said it clearly:

Sanctuary cities literally build a system that caters to criminals. Compassion to criminals is cruelty to the innocent. They try to look good — but they don’t actually do good.

And the fallout lands on the people doing everything right:

🔹 We have clients who have waited over a decade for a court hearing just to pursue their legal process
🔹 They are being skipped in line by people who are abusing due process
🔹 Due process does not mean diplomatic immunity for people coming in and breaking the law

Legal immigrants deserve better. The system needs to work for them — not against them 🙏

🚨 Immigration Judges Ordered to Speed Up Hearings — This Is Extremely Dangerous

The Guardian published a very important report. U.S. immigration judges received a clear directive — a training was conducted to schedule court hearings as quickly as possible. Regardless of the person's situation.

Here's why this is so dangerous:

There are many cases where a person is in deportation proceedings — in court — while at the same time pursuing something through USCIS that could give them legal status. A U visa. VAWA because of abuse by a U.S. spouse. SIJS status. Family reunification.

What lawyers have always done in these situations is ask the judge for more time — your honor, my client is in the middle of a USCIS process that could resolve their situation. And judges used to accommodate this. They would schedule long gaps between hearings and let the USCIS process finish first.

That is likely coming to an end.

Judges will now be scheduling hearings one after another — regardless of what is happening at USCIS. That means you could end up with a deportation order while USCIS is still processing something that would have given you status.

What can help — mandamus:
🔹 A lawsuit against the federal government stating the USCIS process has been dragged out too long
🔹 Not everyone qualifies — there are specific conditions
🔹 But if you are in deportation proceedings and have a USCIS process pending that could give you status — call us now

Let's figure it out together 🙏

🏛️ You Are Only as Safe as Your Most Porous Embassy — Here's the Problem

Immigration attorney Deron Smallcomb makes a point that doesn't get enough attention: there is enormous variability in how embassies around the world grant visas.

Some country teams are incredibly thorough — so consistent and complete in their vetting that the U.S. grants them a visa waiver program entirely. Our friends in Western Europe are a perfect example.

But others? They feel like a yellow brick road for anyone who shows up. And that inconsistency is a real vulnerability in the immigration system.

How is the administration trying to address it?
🔹 The public charge rule — requiring anyone coming to the U.S. to prove they won't be a burden on taxpayers
🔹 This affects people in some countries more than others — and that's intentional
🔹 Tighter scrutiny for countries where visa holders rarely leave when they're supposed to

It's a difficult problem to solve. But the direction the administration is taking — focusing on vetting, consistency and public charge — is a step toward real reform.

⚖️ Why Rubio's Visa Freeze Was Ruled Illegal — And How It Differs from Trump's 2018 Travel Ban

A lot of people are asking: if Trump's 2018 travel ban was upheld by the Supreme Court, why was Rubio's visa freeze ruled against the law?

Immigration attorney Deron Smallcomb explains the key legal difference:

Trump's 2018 ban — US v. Hawaii — was based on denial of entry. The president has clear authority to do that under the law. The Supreme Court upheld it.

Rubio's visa freeze was different. It was put together by Secretary Rubio with nationality as the primary factor for selection. And that's where it ran into trouble — because Congress specifically set out that you cannot discriminate based on nationality in immigration.

The judge didn't call it unconstitutional — he called it against the law. Against what Congress established.

The lesson: the administration has to be narrower and more precise in how it crafts these policies. One word — primary — made all the difference in this ruling.

⚖️ Courts Keep Blocking Trump's Immigration Actions — Here's Why

We keep seeing the same pattern — the Trump administration rolls out an immigration action, a federal judge blocks it. Why does this keep happening?

Immigration attorney Deron Smallcomb explains:

The executive branch has real power on immigration — but that power has legal limits. When an executive action pushes beyond what the law allows, federal courts step in. That's not politics. That's the system working as designed.

What this means:
🔹 Court rulings can protect people directly affected by sweeping executive actions
🔹 The legal battle on immigration is ongoing — nothing is final until the courts say so
🔹 If you are affected by any recent immigration policy change — consult an attorney before making decisions

The courts are not the enemy of immigration enforcement. They are the check on power that goes too far.

📋 How Habeas Corpus Actually Works — What You Need to Know Before Filing

Is your loved one in detention? Habeas corpus is a very powerful tool — but there are important conditions you need to understand first.

When does habeas work?
🔹 The person crossed the border between Mexico and the U.S.
🔹 Lived here for some time before being detained
🔹 If they arrived on a visa — you don't need habeas, you can apply for bond directly

Key requirements:
🔹 No criminal violations — in the U.S. or outside the country
🔹 Time living here
🔹 Show law-abiding peaceful behavior
🔹 Show grounds to remain — like a pending Form 589 asylum application

Habeas can also help even without status — for example if someone has been held more than 6 months and couldn't be deported to their country.

The most important thing to understand:
Habeas is almost never the end of the process. Most likely the federal judge will approve a bond hearing before an immigration judge. For that you need a sponsor with a green card or U.S. passport, with provable income and a special letter written for you.

Be prepared for what comes after habeas 🙏

⚠️ Spain's Border Surge — What It Means for Immigration Policy Everywhere

Immigration attorney Deron Smallcomb joined Rick Leventhal on Newsmax2's The Leventhal Report to react to what's happening at Spain's border right now.

What sparked the surge:
🔹 Spain's Supreme Court ruled on July 8th that sea arrivals go into normal immigration processing
🔹 Smugglers immediately used that as an incentive — normal processing can take decades
🔹 Spain's Prime Minister Pedro Sanchez promised amnesty to millions — they obtained residency and work authorization
🔹 Now tens of thousands more are rushing in hoping for the same deal

The key point from Deron:

"There's no better argument against immigration than illegal immigration. It hurts all of those trying to do it right. When you're swarmed with people who don't meet the criteria, they backlog the system and make it difficult for everybody. Then everybody becomes anti-immigrant."

Legal immigration matters. Efficient processes matter. Illegal immigration undermines both 🙏

⚠️ Orlin's Law — Can Parents with U.S. Citizen Children Stay? The Truth

On July 16th a Democrat from Washington state introduced Orlin's Law to the House of Representatives. Scammers are already telling people it was approved and they're safe. It's not true.

The story behind the law: a 3-year-old boy was tortured to death by his uncle after his mother was deported. She begged for him to be deported with her. The law carries his name.

What it proposes:
🔹 Create a special committee to prevent family separation during deportation
🔹 Parents who pose no public safety threat with U.S. citizen children should not be sent to detention
🔹 A parent ordered deported should decide whether to leave the child in the U.S. or take them along

The reality today:
🔹 Orlin's Law has NOT been approved
🔹 It is likely a populist bill before the November elections
🔹 Today parents without status with U.S. citizen children cannot obtain status until the child is 21

If Orlin's Law is approved — although the chances are quite low — we will be the first to tell you.

Don't believe the scammers 🙏

🚨 Habeas Corpus Stopped a Deportation at the Last Minute — Friday on the Way to the Plane, Monday Free

Just the other day we had a case where a person was literally being taken to the plane for deportation. At the very last minute we stopped it. The habeas was approved. By Monday they were already free.

What habeas corpus gives you:
🔹 Freedom from the detention center
🔹 Time to deal with your immigration situation while free
🔹 You can earn money, hire a lawyer, get consultations
🔹 You can even fly to a third country instead of being deported to your own

Habeas doesn't give you immigration status — but it gives you freedom to fight for it.

State by state:
✅ Texas — we work with habeas and win
✅ Florida, Georgia — high approval rate, federal judges side with people without status
❌ Louisiana, Mississippi — habeas practically not considered, we don't work there for now

Good news: in September there will be a major hearing where federal judges will decide whether people detained more than 90 days in Louisiana, Mississippi and Texas can be released on bond. We are hoping the decision goes in their favor.

If your loved one, dear friend, or close acquaintance is in detention and can't get out on bond — call us. We speak Spanish and many other languages 🙏
