✅ DHS Reversed the Green Card Policy — But Don't Relax Just Yet

On May 22nd USCIS announced that not everyone would be able to get a green card inside the U.S. — only those who could explain extraordinary circumstances for staying.

There was a massive outcry. Immigration lawyers, experts, journalists and rights groups pointed out that adjustment of status is explicitly allowed under congressional law — the Immigration and Nationality Act.

About a week later DHS reversed course: yes, you can still adjust status inside the U.S.

Good news. But here's what you need to know:

The reversal doesn't erase the new questions already introduced into the I-485 interview. There are now four new questions about why you're getting your green card inside the U.S. instead of through consular processing.

⚠️ Conditional Green Card — Don't Get Comfortable: This Could Cost You Your Residency

Many people marry a U.S. citizen, receive their 2-year conditional green card — and assume they're protected. That there's nothing left to do. That deportation is no longer a risk.

This is incorrect.

During this administration, people who miss the deadline to file the petition to remove conditions are receiving notices to appear — and are being placed in deportation proceedings. Why? Because once those 2 years expire without filing, you are technically no longer a resident of the United States.

What you need to keep collecting from day one: 🔹 Joint bank accounts, bills, communication records 🔹 Trips and photos together 🔹 Pregnancy, buying a house or car — all of it counts

Do this right now: 👉 Pull out your green card and check the expiration date 👉 If it's only 2 years — contact an immigration attorney as soon as possible 👉 Don't scramble at the last minute

🚨 Breaking — USCIS May 22, 2026: Not Everyone Can Get a Green Card Inside the U.S. Anymore

USCIS just issued a new policy memo today. Many people who entered the U.S. legally on a visa will now have to leave the country to go through consular processing — instead of adjusting status here.

Who is affected: 🔹 People who came on a tourist, student, or work visa, parole, or TPS 🔹 People who married a U.S. citizen or are reuniting with family 🔹 People pursuing an employment-based green card

The exceptions: ✅ Those granted asylum ✅ VAWA, U visa, T visa, or SIJ status holders ✅ Exceptional circumstances — serious illness, war in home country, no available embassy

What you need to do right now: 👉 Already filed I-485 but no interview yet → most likely you'll need to submit an additional document proving you can't leave the country 👉 About to file I-485 → you'll need to include an extra document explaining why you need to complete the process inside the U.S.

⚠️ He Applied for a U Visa — and Is Still Facing Deportation. Here's Why.

A Mexican citizen actively cooperated with prosecutors after a family tragedy. The district attorney's office signed the 918-B form, he submitted his U visa application to USCIS — and he's still sitting in detention in Pennsylvania facing deportation.
