Trump's 2018 ban — US v. Hawaii — was based on denial of entry. The president has clear authority to do that under the law. The Supreme Court upheld it.

Rubio's visa freeze was different. It was put together by Secretary Rubio with nationality as the primary factor for selection. And that's where it ran into trouble — because Congress specifically set out that you cannot discriminate based on nationality in immigration.

The judge didn't call it unconstitutional — he called it against the law. Against what Congress established.

The lesson: the administration has to be narrower and more precise in how it crafts these policies. One word — primary — made all the difference in this ruling.

📋 How Habeas Corpus Actually Works — What You Need to Know Before Filing

Is your loved one in detention? Habeas corpus is a very powerful tool — but there are important conditions you need to understand first.

When does habeas work?
🔹 The person crossed the border between Mexico and the U.S.
🔹 Lived here for some time before being detained
🔹 If they arrived on a visa — you don't need habeas, you can apply for bond directly

Key requirements:
🔹 No criminal violations — in the U.S. or outside the country
🔹 Time living here
🔹 Show law-abiding peaceful behavior
🔹 Show grounds to remain — like a pending Form 589 asylum application

Habeas can also help even without status — for example if someone has been held more than 6 months and couldn't be deported to their country.

The most important thing to understand:
Habeas is almost never the end of the process. Most likely the federal judge will approve a bond hearing before an immigration judge. For that you need a sponsor with a green card or U.S. passport, with provable income and a special letter written for you.

⚠️ Spain's Border Surge — What It Means for Immigration Policy Everywhere

Immigration attorney Deron Smallcomb joined Rick Leventhal on Newsmax2's The Leventhal Report to react to what's happening at Spain's border right now.

What sparked the surge:
🔹 Spain's Supreme Court ruled on July 8th that sea arrivals go into normal immigration processing
🔹 Smugglers immediately used that as an incentive — normal processing can take decades
🔹 Spain's Prime Minister Pedro Sanchez promised amnesty to millions — they obtained residency and work authorization
🔹 Now tens of thousands more are rushing in hoping for the same deal

The key point from Deron:

"There's no better argument against immigration than illegal immigration. It hurts all of those trying to do it right. When you're swarmed with people who don't meet the criteria, they backlog the system and make it difficult for everybody. Then everybody becomes anti-immigrant."

⚠️ Orlin's Law — Can Parents with U.S. Citizen Children Stay? The Truth

On July 16th a Democrat from Washington state introduced Orlin's Law to the House of Representatives. Scammers are already telling people it was approved and they're safe. It's not true.

The story behind the law: a 3-year-old boy was tortured to death by his uncle after his mother was deported. She begged for him to be deported with her. The law carries his name.

What it proposes:
🔹 Create a special committee to prevent family separation during deportation
🔹 Parents who pose no public safety threat with U.S. citizen children should not be sent to detention
🔹 A parent ordered deported should decide whether to leave the child in the U.S. or take them along

The reality today:
🔹 Orlin's Law has NOT been approved
🔹 It is likely a populist bill before the November elections
🔹 Today parents without status with U.S. citizen children cannot obtain status until the child is 21

If Orlin's Law is approved — although the chances are quite low — we will be the first to tell you.

Just the other day we had a case where a person was literally being taken to the plane for deportation. At the very last minute we stopped it. The habeas was approved. By Monday they were already free.

⚖️ Can the Supreme Court Overturn Birthright Citizenship? The Honest Legal Answer

Two important questions from the birth tourism billboard controversy in Texas.

First — is the hospital legally liable?
The advertisements were pretty narrowly worded — probably not going to get them in legal trouble. But nobody wants the national spotlight on their organization. And they have it now.

Second — will the Supreme Court rehear birthright citizenship?
Five justices grounded this in the Constitution itself. You cannot overrule the 14th Amendment with a statute or by redefining "subject to the jurisdiction of." What Speaker Johnson and other congressmen are currently promoting makes for a great press release — but absent a constitutional amendment nothing is going to change on this issue.

Where Congress actually has real power right now:
🔹 Fix the immigration courts
🔹 Fund the courts and address the massive backlog
🔹 Modernize legal immigration

That's where a legislative fix would actually stick. That's where the real work needs to happen 🙏

🏥 Birth Tourism and the 14th Amendment — Are Hospitals Selling U.S. Citizenship?

Texas hospitals were advertising C-sections in Mexico on billboards with U.S. phone numbers. When a hospital markets that service with a U.S. phone number, that's not health care outreach — that's a citizenship business.

Republicans including Congressman Chip Roy raised the alarm. The Texas governor called for an HHS investigation. Mission Regional Medical Center responded saying it doesn't support or facilitate any unlawful activity.

Here's what's already the law:
🔹 Visa fraud — lying about your purpose for travel to the U.S. — is already illegal
🔹 Consular officers and CBP already have authority to deny entry
🔹 The enforcement tools exist — they need to be used more strongly

The 14th Amendment debate:
🔹 Birth tourism is a real issue — but operates at tens of thousands per year
🔹 Compared to the tens of millions who came during the Biden administration — the scale doesn't necessarily justify changing the Constitution

Enforce the existing laws first 🙏

❌ 5 Myths About Habeas Corpus — Here's What's Actually True

Habeas corpus is one of the strongest tools for getting someone out of ICE detention. But there's a lot of misinformation out there. Let's clear it up.

Myth 1 — It takes the same time everywhere:
In New Jersey we had a case where the decision came in 24 hours and the person was released immediately. In Florida it can take about two weeks. Time varies significantly by state.

Myth 2 — It works in every state:
It works in almost all states. But Louisiana and Mississippi are a black hole — habeas is basically not considered there. We don't take cases there for now. Texas is in the same 5th circuit but we win habeas cases there regularly.

Myth 3 — You need 6+ months in detention:
False. You can file under various circumstances — not just after 6 months.

Myth 4 — You need U.S. status:
Not always. There are situations where people without status can still be released through habeas.
