Navigating Sibling Conflicts in Trusts and Estates

Sibling conflicts over an inheritance can turn a difficult time into a serious legal dispute.

Disagreements often begin when one sibling is serving as trustee or executor and the others start asking questions:

• Why haven’t assets been distributed yet?
• Where did the money go?
• Why is one beneficiary receiving different information than everyone else?
• Can a trustee sell property without everyone agreeing?
• What happens if you believe someone is mismanaging the estate or trust?
• What can you do if a sibling refuses to provide an accounting or other information?

Whether the assets are being handled through a trust or California probate, beneficiaries may have important legal rights. Trustees and executors also have legal duties that can become especially important when family relationships begin to break down.

The earlier you understand the trust, will, financial records, property ownership, and actions taken by the person in control, the better prepared you may be to protect your interests.

Money disappeared after someone died? That may be more than a family disagreement.

When someone passes away, it is not uncommon for family members to suddenly start asking questions:

Where did the money go?
What happened to the jewelry?
Why is a bank account suddenly empty?
Who took the valuables from the house?
Was property transferred before anyone else knew about it?

Estate property does not simply belong to whoever gets to it first.

In California, an interested person may be able to ask the probate court to determine whether property belongs to the estate and order its return.

And when someone is found to have wrongfully taken, concealed, or disposed of estate property in bad faith, the consequences can be significant. California Probate Code §859 can impose liability for twice the value of the property recovered. The court may also award reasonable attorney's fees and costs in appropriate cases.

That can apply to more than cash. Disputes can involve:

• Bank and investment accounts
• Real estate
• Vehicles
• Jewelry and collectibles
• Business interests
• Personal property
• Property transferred before death
• Assets someone claims were "given" to them

Of course, missing property does not automatically mean someone committed wrongdoing. Transfers may have been legitimate, assets may pass outside probate, and ownership can be complicated.

But if the explanation does not add up, do not rely solely on what the person controlling the property tells you.

Records matter. Bank statements matter. Deeds matter. Account histories matter. And sometimes the probate court is needed to determine what actually happened.

A trustee has control over the trust, but that does not mean they can do whatever they want.

If you are a beneficiary, certain patterns should get your attention.

🚩 The trustee stops communicating
🚩 Months pass with no explanation
🚩 You cannot get an accounting
🚩 Trust assets appear to be used personally
🚩 One beneficiary gets special treatment
🚩 Property is sold under suspicious circumstances
🚩 Questions are met with pressure, secrecy, or intimidation

Not every delay or disagreement means a trustee has done something wrong. But when multiple warning signs start appearing, it may be time to ask harder questions.

Beneficiaries have rights. Trustees have duties. And waiting too long can sometimes make a trust dispute more difficult to address.

Your sibling is the trustee. That does NOT make the trust theirs.

Being named trustee gives someone control over trust assets, but that control comes with serious legal responsibilities.

In California, a trustee generally has a duty to administer the trust according to its terms and solely in the interest of the beneficiaries. If there are multiple beneficiaries, the trustee also has a duty to deal with them impartially while taking their different interests into account.

That means being the trustee does not automatically give your brother, sister, parent, or other relative the right to:

• Treat trust money like their own
• Use trust property for personal benefit
• Favor themselves over other beneficiaries
• Make transactions that create an improper conflict of interest
• Ignore what the trust actually says
• Assume that being "in charge" means nobody can question their decisions

Not every disagreement with a trustee means there has been a breach of fiduciary duty. But unexplained transactions, missing assets, unusual transfers, self-dealing, favoritism, or decisions that appear to benefit the trustee personally can be significant warning signs.

Family relationships do not erase fiduciary duties.

A trustee manages the inheritance. They do not own the inheritance.

If you are a California trust beneficiary and something about the administration of a trust does not add up, getting answers early can matter.
