Why apply for DCSS (Department of Child Support Services)? DCSS has enforcement methods that may be useful to locate non-custodial parents, DCSS can enforce the child support order wherever the non-custodial parent lives, DCSS will modify the child support order if the non-custodial parent has a change of income, keep disbursement history, DCSS can levy bank accounts, and it is free! 😊 Of course, you would likely benefit from counsel when one parent is not forthcoming about his income, has multiple bank accounts, or is self employed (these are some of the challenging cases where I recommend an attorney 100% of the time). ⚖️

Under the CA Family Law Code and Code of Civil Procedure, there are several mechanisms by which a family court litigant can seek attorney fees and costs from the other party. Our focus today is on Family Code Section 2030 et seq. ⚖️ California court’s are authorized to make an order requiring any party to pay a reasonable portion of the opposing party’s attorney’s fees, so that the latter can maintain or defend a proceeding. To make this award, the court’s consider the “need versus ability to pay” analysis. When determining “need” the court must assess this need relative to the other party’s ability to pay. The court will consider all evidence of the parties’ assets, current income, investments, and income producing properties. Speak to an experienced family law attorney if you’re in this position and believe the other party has the ability to pay! ☎️
