Sometimes a law enforcement investigation is so bad it’s actually good for the person accused (right or wrong) of a crime. 🤔

What’s the best way to take advantage of THEIR mistake(s)? By not making your own and keeping YOUR mouth closed. 🤐

Here's something every criminal defense attorney in San Diego tells families they meet with. "We'll fight for you."

Almost none of them explain what that actually means.

The reality is, there's a real difference between attorneys who simply take on a case and attorneys who actually work it.
And the difference shows up in the first conversation, not the courtroom.

Here are the questions most families don't think to ask. They should.

How many cases like this have you actually handled? How many have gone to trial? How up to date are you and the firm about changes in the law relating to these offenses?

Who is actually going to be working this case day to day? Will it be the attorney I'm meeting with, or will it be handed off to someone junior I haven't met or can’t even find on the website?

What's the realistic range of outcomes, and what do each of them require?

What does communication look like over the next six days and six months?

In this video we go through what to look for, what to run away from, and the signs a criminal defense firm may actually be a mill, instead of a team that is with and for their clients each step of the way, defending their freedom and future at the highest of levels. You got to know what you're paying for. Watch this before hiring anyone in San Diego, even us.

Protect your freedom. Protect your future. Know your rights.

Most families facing a criminal case in San Diego have no clear picture of what's actually going to happen between today and the day it ends.

They get told to "just wait for your court date," as if waiting were a strategy.

They get a flood of information from people who don't really know what is actually going to happen.

And they spend the most stressful weeks of their life with no roadmap toward regaining control of their future.

In this video we break down the whole thing. From the first step where the case gets heard, all the way through the verdict assuming the jury reaches one.

What each stage actually is.

What happens at each one. When to bring in a qualified, locally experienced criminal defense attorney. What to be saying. What not to be saying. What to be doing. What not to be doing.

The bottom line is this:

There's enough stress in any criminal case, no matter what the charge is. There shouldn't be any more anxiety based on uncertainty that can be mitigated

For a family staring down a criminal case in San Diego without a clear picture of what the next several months look like, this is the Reader's Digest version of what every client gets in their first meeting with us.

Protect your freedom. Protect your future. Know your rights.

A common scenario families in Chula Vista find themselves in, completely without warning, is the knock on the door from a detective that nobody saw coming.

The person answers.

The detective is polite. Asks if they can come in for a few minutes. Says they just want to "clear some things up."

Most people say yes. They cooperate. They answer the questions. They think explaining their side is the smart move.

And it never ends well when you go down that path.

Here's what most people don't realize.

By the time a detective is at someone's door, there's already been an investigation going on for days, if not weeks, sometimes months. They've talked to other people. They've likely already formulated an opinion as to what they think happened.

They are not at that door to hear a defense.

They are there to collect one more piece of evidence to use against you, to get one step closer toward an arrest and conviction.

What should have happened?

Politely decline to answer questions. If they leave a business card, get it to a qualified, locally experienced criminal defense attorney before you do anything else.

Don't call them back yourself.

In this video we break down what's actually happening on the other side of that knock, what detectives are allowed to do, what you're allowed to do, and the smart middle ground that protects the family without making the situation worse.

Protect your freedom. Protect your future. Know your rights.

Imagine a situation in Oceanside where a nurse with fifteen years of experience gets pulled over on a Saturday night and charged with a DUI. No accident. No injuries. High blood alcohol reading.

They hire a DUI lawyer.

The lawyer works out what looks like a great deal. Reduced charge. No jail time. Fine. Classes. Probation.
On paper, a clean outcome. The kind another client might high-five their attorney over.

Six months later the nursing license is gone.

The reporting obligations to the nursing board were triggered by the plea. The board opens its own investigation. The career ends in a way that had nothing to do with what landed the nurse in the criminal courtroom.

This is what almost no one tells people with a professional license on the line.

A "fantastic deal on paper" can be the worst possible outcome for the person it actually happened to.

Whether it's a doctor, a nurse, a lawyer, a real estate agent, an engineer, the list goes on and on. This is also true when immigration status is in play.

Even being investigated for a crime, before any charges are filed, can carry consequences that go far beyond anything that happens inside a criminal courtroom.

What to look for in a criminal defense firm in this situation:

Experience specifically with cases like this one. Not an attorney that does criminal defense work on occasion. An actual criminal defense attorney with real experience handling a volume of cases where collateral consequences were what actually mattered to the client.

Proactive communication with administrative law and professional licensing specialists, before the plea ever happens.
Wait and see is not a strategy. Not when this much is on the line.

In this video we walk through specific examples of outcomes that looked great on paper but cost the person everything.
Protect your freedom. Protect your future. Know your rights.

Imagine a situation in Poway where a couple has an argument late at night. Neighbors hear raised voices and call the police.

By the time officers arrive, the argument has already ended. Cooler heads have prevailed.

But someone is unfortunately likely going to be arrested. That's how California handles these calls.

The officers are not there to figure out who was wrong.

They are there to document, separate, and make an arrest based on what they see and what they're told in the first twenty minutes. Whatever actually happened is a secondary question that gets sorted out later. Sometimes much later.

And what gets said in those twenty minutes, by either party, ends up in a report that's very hard to walk back.

Here's what's essential to understand.

A domestic violence accusation in California is not a private matter that the parties can resolve between themselves. It’s far more complicated than one party “dropping the charges” against the other.

Once the call is made, the decision about whether the case moves forward is no longer up to the person who called. The prosecutor makes that call. Even if the accuser later says they want to drop it.

This is why getting a qualified, locally experienced criminal defense attorney involved in the first 48 hours matters more in this type of case than almost any other.

In this video we walk through what actually happens after one of these calls in San Diego. The arrest. The protective orders. The decisions that get made in the first week that shape everything that comes next.

Protect your freedom. Protect your future. Know your rights.

Imagine a situation in Pacific Beach where someone leaves a bar after a couple of drinks thinking they're fine to drive, and pulls out onto Mission Boulevard.

Within the first half mile, there are lights behind them.

They pull over.

They answer the officer's questions honestly. They're polite. They try to explain they only had two beers.

They think honesty and cooperation are helping.

The reality is, everything they said in the first three minutes is now evidence against them.

Every answer about where they came from, how many drinks, when the last one was. That's going into a police report. That report is going to a prosecutor. Possible defenses may now be unavailable.

In San Diego, DUI prosecutors come out of the gate hot. What should have happened in that traffic stop?

Politely decline to answer questions beyond identifying information. License and registration. That’s it. Don't perform field sobriety tests that are voluntary.

Get a qualified, locally experienced criminal defense attorney involved before the arraignment, not after.

Because by the arraignment, a lot has already been decided that most people don't realize is decided.

In this video we walk through the whole criminal case process in San Diego. What happens. What matters. What a defense attorney should be doing at each stage that most aren't.

There's enough stress in any criminal case.

Protect your freedom. Protect your future. Know your rights.
