I’ve been getting a lot of calls from people interested in restoring their gun rights after hearing about the recent announcement from the federal government. Even if the federal government were to grant your application, that is not going to be enough. While it may restore your federal gun rights, it doesn’t restore your rights under state law. Extra steps will need to be taken to restore those rights under state law.

For example, if you have a felony conviction for a state law offense, you can still be charged with being a felon in possession of a firearm. If your prior felony conviction is eligible, you will need to have it reduced to a misdemeanor. For most cases, this will restore your firearm rights under California law.

One of the most frequent calls I get are from people who want to restore their firearm rights. The thing is, even though California allows the ability to reduce a prior felony conviction to a misdemeanor, which then would allow you to possess fi****ms, you are still prohibited under federal law because it is still recognized as a felony conviction.

The announcement from the federal government that they will be accepting applications to restore firearm rights under 18 USC section 925(c) is going to fix that problem.

I am keeping a close eye on this development to be ready to assist anyone interested in restoring their firearm rights. The government indicated they will be releasing and accepting applications 30 days from the initial announcement on August 17th.

A new avenue for federal firearm rights restoration is about to become available.

Under 18 U.S.C. § 925(c), certain individuals prohibited from possessing fi****ms under federal law may seek relief from their federal fi****ms disabilities. For decades, this avenue for relief has been effectively unavailable.

The U.S. Department of Justice has announced that applications for relief will become available 30 days after August 17, 2026.

This may provide an important new opportunity for eligible individuals seeking to restore their firearm rights under federal law.

Lieberman Law, APC will be assisting clients with applications for relief under 18 U.S.C. § 925(c) once the application process opens.

A California CCW denial is not always the end of the process.

Depending on the reason for the denial, California law may provide a legal avenue to challenge the issuing agency’s decision through the courts.

Not every denial should be appealed, and every case is different. The key is understanding why your application was denied and whether there is a legal basis to seek judicial review.

Receiving a CCW denial can be discouraging, but it does not always mean your case is over.

I’m grateful for clients who take the time to share their experience and trust me to represent them through the legal process.

In this case, my client was denied a California CCW license. After filing a petition challenging the denial, the court reversed the decision and ordered the issuing agency to proceed with issuing the license.

Every case is different, and not every denial can or should be challenged. But if your application has been denied, it’s important to understand your legal rights and whether judicial review may be available.

Not every California CCW application is approved.

California law identifies several reasons an issuing agency may deny a CCW application. In this video, I discuss two of the most common:

• Whether the applicant is determined to be a danger to themselves or others.
• Whether the applicant knowingly provides false or incomplete information during the application process.

Receiving a CCW denial can be frustrating, but it does not always mean the process is over.

California law provides a legal process to challenge certain CCW denials through the courts. Depending on the circumstances, you may have options to seek judicial review of the issuing agency’s decision.

Who is eligible to receive a California CCW license?

While every application is evaluated on its own facts, there are a few basic eligibility requirements every applicant should understand.

Generally, you must apply through the sheriff’s office or police department that serves the area where you reside. You must also be legally eligible to possess a firearm under California and federal law.

In this video, I provide a brief overview of these eligibility requirements and discuss why prohibited person status is one of the first issues that can affect your ability to obtain a CCW license.
