After a serious car accident, medical expenses, lost wages, and other financial losses can add up quickly. Unfortunately, the at-fault driver’s insurance coverage may not be enough to compensate you for everything you’ve lost. This is especially true in accidents involving catastrophic injuries, lengthy hospital stays, permanent disabilities, or multiple injured victims.

So, what happens when a car accident personal injury claim exceeds the at-fault driver’s insurance policy limits in California?

Understanding how insurance limits work and what options are available can help protect your financial future after a serious collision.

A driver approaches an intersection, looks both ways, and begins making a turn. A motorcycle is coming from the opposite direction in plain sight – but the driver never seems to recognize that it is there.

Another driver looks directly toward a crosswalk before turning right but somehow fails to notice the pedestrian walking across the street.

After a crash like this, drivers sometimes say something difficult to understand:

“I looked, but I didn’t see them.”

Psychology may help explain how that can happen.

Inattentional blindness - sometimes informally called inattention blindness - is a psychological phenomenon in which a person fails to consciously notice an unexpected but visible object because their attention is focused somewhere else.

Any motor vehicle collision can cause serious injuries, but some types of crashes are particularly likely to produce catastrophic or fatal trauma.

Head-on collisions, rollover crashes, and high-speed T-bone or side-impact accidents are among the types of car accidents most commonly associated with the worst injuries. These crashes can expose occupants to tremendous forces, intrusion into the passenger compartment, multiple impacts, ejection, or violent movement of the head, spine, and internal organs.

The severity of any individual accident depends on many factors, including vehicle speed, the angle of impact, vehicle size, seat belt use, airbag deployment, occupant position, and whether the passenger compartment remains intact.

Hands-free technology has become standard equipment in many newer vehicles. Bluetooth calling, voice assistants, steering-wheel controls, Apple CarPlay, Android Auto, and voice-operated navigation systems are all designed, at least in part, to reduce the need for drivers to physically interact with a phone.

But does hands-free technology actually prevent distracted driving?

The most recent Federal Highway Administration (FHWA) data reports that commercial motor vehicles were involved in 31% of fatal work-zone crashes in both 2023 and 2024.

The statistics are clear: large commercial vehicles play a disproportionately large role in the nation’s deadliest work-zone crashes.

Petco Park and the neighboring Gaslamp Quarter are among the busiest destinations in San Diego. On a Padres game day, during a major concert, or when several downtown events overlap, tens of thousands of people can converge on a relatively compact section of the city.

That creates a particular pedestrian safety challenge when an event ends.

A pedestrian accident outside Petco Park or in the Gaslamp Quarter can involve much more than determining whether a vehicle struck someone in a crosswalk.

In California, a parent generally cannot simply accept a settlement check on behalf of a child and deposit the money into a personal bank account. Instead, settlements involving minors typically require court approval through a process commonly known as a Minor’s Compromise. The court also determines how the child’s settlement proceeds will be protected.

The goal is straightforward: the settlement belongs to the child, and California law provides safeguards designed to preserve that money for the child’s benefit.

A call to 911 can capture what witnesses saw in the immediate aftermath of a car accident, fall, assault, or other injury-causing event. Meanwhile, emergency dispatch records can create a time-stamped chronology showing when the call came in, what information was reported, when emergency personnel were dispatched, and how the situation developed.

When liability or the severity of an injury is disputed, 911 recordings and dispatch records can become important evidence in a California personal injury claim.

As autonomous vehicles become a more familiar part of California roads, personal injury law will have to continue adapting to accidents in which the line between driver error and technological failure is increasingly complicated.

For motorists in San Diego, where commercial trucks regularly share congested freeways and surface streets with passenger vehicles, understanding why rear-end truck crashes happen can help drivers recognize – and potentially avoid – the circumstances that make them so dangerous.

Rear-end collisions are among the most common types of accidents involving commercial trucks. While these crashes can happen between any two vehicles, they become especially dangerous when the striking vehicle is an 18-wheeler, tractor-trailer, delivery truck, or other large commercial vehicle.
