The Biden administration recently released three immigration focused executive orders. These orders create several changes to the immigration system and pledge to review many of the current policies. Read below for a short summary of each executive order:

The first order establishes a new task force geared at the reunification of families separated under the Trump administration.
The second order indicates a thorough review of the so-called Migrant Protection Protocols. It rescinds many of Trump’s asylum restrictions making the asylum process more accessible for those with claims. The third order establishes a “Task Force on New Americans” which aims to further immigrant integration and inclusion and pledges a review of Trump era changes to the immigration system.

These moves by the new administration make good on several campaign promises made by President Biden and signal many more changes aimed at reforming the U.S. immigration system.

Recently released documents from the Biden administration detail the extensive changes to our immigration system. Many classes of non-citizens will be eligible for relief upon the proposed bill's passage. If you are a part of the following groups, make sure to follow our page for updates, and call our office to be put on a waitlist for a consultation:

DACA recipients, TPS recipients, and certain seasonal farmworkers
will be eligible for green cards immediately.


Undocumented non-citizens will be eligible for Temporary Legal
Status immediately. Applicants are required to pass a criminal
background check, national security checks, and pay taxes


Undocumented non-citizens with a criminal background may also
be eligible. As of now, it is not known what criminal convictions
will be waived. Please follow this page for updates.


Noncitizens with asylum claims will be eligible to apply even if
they have resided in the U.S. for over 1 year. If you think you have
a valid asylum claim, call the office to set up a consultation.


Immigrants who face illegal labor conditions are eligible to apply
for U-Visas. Illegal conditions can include excessive hours, illegal
wage garnishment, payment below the legal level, or hazardous
or unsafe working conditions.


Immigrants with approved family-sponsorship petitions will be
able to join family in the United States on a temporary basis while
they wait for green cards to become available.


Immigrants who are subject to a 3 or 10 year ban due to unlawful
presence may be eligible for new forms of relief, as the bill
eliminates this bar to admission.

President Joe Biden announces a sweeping change to the immigration system, opening a 8 year path to all 11 million undocumented immigrants within the United States.

Under proposed legislation "those living in the U.S. as of Jan. 1, 2021, without legal status would have a five-year path to temporary legal status, or a green card, if they pass background checks, pay taxes and fulfill other basic requirements. From there, it’s a three-year path to naturalization, if they decide to pursue citizenship."

In addition, DACA and TPS recipients will have a similar but shorter route to a green card and naturalization.

In a speech last Tuesday, Vice-President Elect Kamala Harris outlined several key changes the new administration plans to implement within the immigration system. This includes a 5 year decrease in the amount of time it takes to become a citizen, automatic green cards for protected undocumented immigrants (DACA and TPS recipients), and bolstering the amount of immigration judges.
