Stacey works with community heroes to create free or low-cost estate planning documents and basic family law counseling. Her quarterly community workshops provide essential information on Wills & Trusts. She believes that knowledge of the law is power and should be equally shared. Originally from Buffalo, New York, Stacey, her husband, daughter, and dog are proud members of Bills Mafia. Stacey graduated with honors from the University of Arizona with a degree in Sociology & Statistics, before attending California Western School of Law in 2004. Headed back to the office from beautiful Encinitas. 💙 We completed Trust Amendments and updated Wills & Powers of Attorney for lovely clients.

Estate planning documents, like your Trust, Will, and Power of Attorney, are all living, breathing documents. They're meant to change with you as your life changes.

I recommend Clients come back in every 5 years for a review. It's very common for Clients to change things like nominations for Executors & Guardians of minor children. Our relationships naturally shift over time, and sometimes new people fit these roles better.

Our property also changes over time, as we buy and sell things, open and close accounts. A review is a great time to update property lists on your documents, and to make sure your beneficiary & title designations are up to date.

Prenuptial Agreements are the only way to have your own property after marriage, for most assets, debts and income.

It doesn't matter if only your name is on the title.

Without a Prenuptial Agreement, if you purchase property with money you earn after marriage, then your spouse has an interest in the property. If you use ONLY money that you earn after marriage to purchase property, then your spouse owns half.

Similarly, if you deposit money that you earn after marriage into a bank account, your spouse owns some of the money. If the account contains ONLY money you made after marriage, then your spouse owns half. It doesn't matter that your spouse's name isn't on the account.

If you're engaged, and you want your own bank account after marriage, it's time for a Prenup consultation. The same thing goes for a home, a retirement account, a business, or any other asset or debt.

If you're already married, a Postnup consultation is the way to go.

♦ Prenuptial Agreements take about a month to prepare. It's best to avoid deciding on terms in the last month before the wedding, if you can help it. You don't want to feel forced into quick decisions or add stress to that busy time.

♦ College Estate Plans take about 2 weeks to prepare. There's a lot to do before you leave home. Get the peace of mind that comes from completing these documents and avoid end-of-summer stress.

♦ Trust Estate Plans take about 2 weeks to prepare. Completing them before travel brings significant peace of mind. June is the perfect time to start if you want your Trust completed before a July or August vacation.

♦ Divorce in California takes a minimum of 6 months to complete. Filing in June means your case can be finished before Christmas.
