The 60-day rule for physician signatures on the immigration medical exam results form has been eliminated by USCIS. As of March 31, applicants for a green card may submit Form I-693 up to two years after it has been signed by a civil surgeon. Prior to this change, it was necessary for applicants to ensure that the form was signed by a civil surgeon within 60 days of submitting their green card application or face the possibility of denial.

A spousal visa or marriage green card, for instance, may require 13 to 33 months. Although you may meet the eligibility criteria for a family-based green card, the process of acquiring and physically possessing the card is not instantaneous, and it takes time.

Who is eligible for an Adjustment of Status (AOS)? This is the first of several posts over the next few days to explain who is eligible to apply for an Adjustment of Status. There are certain immediate family relatives of U.S. citizens who are eligible. A U.S. citizen may petition for a spouse, unmarried child under 21 years old, or parents if the US citizen is at least 21 years old. There are other family relationships that may qualify as well. The USCIS Form I-130 is used to initiate the process with the government.

What's an Adjustment of Status (AOS)?

When you're in the United States and you want to apply for a green card, you have two options: You can either leave the country and apply at a U.S. consulate, or you can apply for an adjustment of status (AOS).

AOS is the application process that certain foreign nationals present in the United States can use to apply for a green card. When you apply for a green card through an AOS, you don't have to go back to your home country when your visa expires. You'll be allowed to remain in the United States until the U.S. Citizenship and Immigration Services (USCIS) completes their processing of your application.
