Myth: If you and the other driver have the same insurance company, it will be fair to both of you.

Fact: The adjuster works for the insurance company, not for either driver.

If one driver sues the other, the insurer may pay a separate defense lawyer for each driver it insures. Texas ethics rules say one lawyer cannot represent opposing parties in the same lawsuit. The lawyer hired to defend you is there to defend the claim against you. That lawyer is not assigned to bring your own injury claim.

Fault matters too. Under Texas law, a driver found more than 50 percent responsible recovers nothing. At 50 percent or less, the recovery is reduced by that driver's share. Ask for every fault decision in writing.

The claims floor, the van, and now the phone. Good Faith Mutual is calling.

GOOD FAITH MUTUAL, Episode 4: This Call May Be Recorded. The day after a wreck, a sweet adjuster calls a hurt driver to "check on him." Her call software coaches her the whole time and keeps a running payout number. Then he starts asking questions of his own. It does not go well for the software.

The real-world part: insurance companies look for reasons not to pay you. If the other driver's insurance company calls, talk to a lawyer before you give a recorded statement.

New episode every Friday.

One screenshot rarely proves the other driver was on their phone.

After a Texas crash, what tends to hold up is a timeline. The crash time on the CR-3 report. The timestamp on a public post. What a witness saw. Dashcam or business video. Later, phone, app and vehicle data gathered the lawful way.

If you saw a public post near the time of the wreck:
1. Screen record it from the public profile so the account name, handle and URL show.
2. Write down the timestamp it displayed and the exact time you captured it.
3. Save an untouched original before you mark up any copy.

What not to do: touch the other driver's phone, guess a password, message the driver, or follow them from a fake account. Those steps can hurt your credibility and the evidence.

After a crash, what should you photograph?

Only if safe: vehicles and damage, license plates, and the wider scene. Safety and medical needs come first. Never step into traffic for a photo.

A certified-mail receipt proves a preservation letter arrived. It does not prove the truck's video was saved.

After a commercial truck crash in Texas, evidence can sit with several different companies: the motor carrier, the equipment owner, the insurer, a tow yard or repair shop, and the camera or ELD vendor. A letter that reaches one of them may never reach the person who actually controls the data or the truck.

That is why delivery is only step one. The follow-up questions matter more:
1. Who applied the hold?
2. Which vehicles and systems does it cover?
3. Were outside vendors told to stop routine deletion?
4. Where is the truck now, and is a repair or salvage sale planned?

Two more points from the guide: there is no universal Texas 48-hour deadline for this letter, and sending one does not extend the deadline to file a lawsuit.

Hurt in a truck crash and the medical bills are already showing up? Here is something many people don't expect: the trucking company's insurer usually will not pay those bills as they arrive.

That insurer is a third-party liability carrier, not your health plan. It typically waits until fault, damages and coverage are investigated. Texas law generally does not require you to bill your own health insurance first, but the bills still need a plan while the claim is pending.

Three steps that help:
1. Give your providers your health insurance information and ask in writing if they refuse to bill it.
2. Check your auto policy for PIP and MedPay, which may help with early medical bills.
3. Save every bill, EOB, lien notice and collection letter. Paid amounts and unpaid balances both matter later.

Also: health insurance, hospital liens, Medicare or Medicaid may seek repayment from a settlement, so those claims should be reviewed before any case is resolved.

Myth: If the trucking company sends you to its clinic after a crash, you have to go there.

Fact: If you are not the trucking company's employee, it usually does not get to choose your doctor. That goes for drivers, passengers, pedestrians and family members hit by a commercial truck.

A company occupational clinic is built for work-status paperwork, drug testing and workers' comp forms. That can be useful in the right setting. It is not a substitute for an ER visit when you have a head injury, numbness, chest or belly pain, or pain that keeps getting worse.

Your first medical record matters too. Insurers often treat it as the anchor for how serious the injury was.

After a Texas truck crash, do not skip needed emergency care because the trucking company points you to its clinic. Serious symptoms mean ER or 911 first.

After a crash, most people grab their phone and start taking pictures. When the truck carries a diamond-shaped hazmat placard and something is leaking, that instinct can hurt you.

Distance comes first. Get uphill, upwind and upstream if you can do it safely. Stay out of liquid, runoff, smoke and fumes. Call 911 and say a placarded hazardous materials truck is leaking.

If you can see the placard number or the company name from where you are, tell the dispatcher. If you can't, don't walk closer to read it. Use your zoom. Responders can identify the cargo through shipping papers and carrier records.

Then get checked by a doctor, even if you feel fine, and make sure the record says chemical exposure, not just car accident.
