⚖️ “Over the past couple of weeks we’ve seen more where that presumption of innocence is erased or eroded,” says Attorney Alfonso Cabañas. Being accused of a crime does not mean someone is guilty.

The presumption of innocence is a fundamental principle of our justice system, and it deserves to be protected.

Too often, someone accused of a crime is treated as though they’ve already been convicted. Criminal defense attorney Alfonso Cabañas discusses how quickly an accusation can turn into a guilty verdict in the court of public opinion.

One arrest. One headline. One viral post. Suddenly, thousands of people have already decided someone is guilty without hearing a single piece of evidence.

Criminal defense attorney Alfonso Cabañas was recently invited to join “A Good Lawyer Podcast,” where he discusses how social media has contributed to the erosion of one of our most fundamental legal protections: the presumption of innocence.

“For us defense lawyers, instead of starting from zero, it’s almost like we are starting at negative 100.”- Alfonso Cabañas

When public opinion reaches a verdict before a jury does, the fight for a fair trial becomes even more challenging.

An accusation is not a conviction. And the presumption of innocence applies to everyone.

🎧 Watch or listen to Alfonso’s full interview on A Good Lawyer Podcast, where he also discusses capital murder trials, not guilty verdicts, courtroom strategy, and the future of criminal justice.

🚨 PARENTS OF TEENAGERS — READ AND SHARE!

⚖️ In Texas, once you turn 17 years old, you are considered an adult in the criminal justice system.

🚔 That means if you’re arrested and charged with a crime, your case will generally be handled in ADULT criminal court, not juvenile court.

🔒 If you’re sentenced to incarceration, you could end up in an adult correctional facility instead of juvenile detention.

⚠️ At 17, one bad decision can carry adult consequences.

👨‍👩‍👧‍👦 Parents, have this conversation with your teenagers!

📲 SHARE THIS WITH EVERY 16- AND 17-YEAR-OLD YOU KNOW! They need to understand what’s at stake.

📱 YOUR PHONE MAY KNOW MORE ABOUT YOU THAN YOU THINK.

You don’t have to send a text, make a call, or post on social media for your phone to leave behind digital evidence.

In a criminal investigation, your cell phone may reveal:

📍 Location data: Where your phone traveled, when it arrived, and how long it remained in an area.

🔋 Battery activity: Battery levels and charging records may help investigators reconstruct a timeline.

📲 App activity: Which apps you opened and when you used them.

📶 Cell tower connections: Records that may help place your phone within a particular geographic area.

💬 Deleted messages: Depending on the device and available records, investigators may recover communications you thought were gone.

Even when you aren’t actively using your phone, it may continue generating or storing data.

But here’s what matters: Your phone’s location does not automatically prove YOUR location, and digital evidence does not automatically prove guilt.

At Cabañas Law Firm, we understand that the prosecution’s interpretation of digital evidence does not always tell the whole story.

Your phone may tell a story. Make sure your defense tells yours.

Federal prosecutors wanted former senior USCIS official Lukman Owolabi Ganiyu detained pending trial.

Criminal Defense Attorney Alfonso Cabañas fought for his release and won. 🔥

Speaking to Newsweek, Alfonso made the defense position clear: Ganiyu “denies any criminal conduct” and disputes the government’s characterization of the financial transactions and immigration applications cited in the complaint.”

Alfonso also said Ganiyu will comply with all court-imposed conditions and that the defense plans to “contest the allegations through the judicial process, where prosecutors must prove their case beyond a reasonable doubt.”

The government has made its allegations. Now it has to prove them. For now, Alfonso won the first fight: his client will defend himself from home, not from behind bars.

The jailhouse group chat has been ACTIVE this week. And we get it. 🔥

Alfonso Cabañas recently defended Daniel Gonzalez in a MURDER trial, and the jury found Gonzalez NOT GUILTY. The alleged murder weapon was found in Daniel’s possession, and that’s the kind of fact that can make a case look impossible. It wasn’t impossible for Alfonso Cabañas.

The jury heard the evidence. The State had the burden. Alfonso fought the case.

NOT GUILTY. 🔥

Having a bad fact in your case doesn’t make you guilty and beyond a reasonable doubt still means something.⚖️

When you’re facing Capital Murder, Murder, or a serious felony in San Antonio or Bexar County, you want a criminal defense attorney who isn’t afraid of the facts, the courtroom, or the fight. 🔥

ARE FLOCK CAMERAS LEGAL — OR HAVE WE GONE TOO FAR?

You drive to work.
You pick up your kids.
You go to the gym.
You stop for dinner.

Along the way, automated license plate readers known as Flock cameras may be capturing your vehicle’s license plate, location, and the time you passed by.

And you don’t have to be accused of a crime for your vehicle to be scanned.

In Bexar County, the Sheriff’s Office currently reports 33 license plate reader cameras and more than 750,000 unique vehicle detections in the last 30 days.

Think about that.

Technology that can help police locate stolen vehicles and investigate crimes can also create records of where vehicles have been and when.

There are even online Flock camera locators and crowdsourced maps where people are identifying reported camera locations around San Antonio and across Texas.

So here’s the bigger question:

Should law enforcement be able to use this technology to track a vehicle’s movements without a warrant?

And at what point does public safety become a Fourth Amendment privacy issue?

As a San Antonio criminal defense attorney, these are exactly the kinds of questions that matter when technology becomes evidence in a criminal case.

I want to hear what you think:

Do you believe Flock cameras and automated license plate readers should be legal?

YES or NO — tell me why in the comments.

NOT GUILTY. Daniel Gonzalez is not guilty. ⚖️

After a hard-fought trial and nearly nine hours of jury deliberations, our client was found NOT GUILTY of killing Donnell “Donnie” Sterling.

The jury initially reported that it was deadlocked. They were sequestered overnight, returned the next morning, continued deliberating—and ultimately reached a verdict.

From the beginning, Criminal Defense Attorney Alfonso Cabañas maintained that his client did not commit this shooting. The State’s case relied heavily on a key witness whose story was challenged repeatedly at trial.

As Alfonso told the jury:

“That is not proof beyond a reasonable doubt.”

A life was tragically lost, and we do not lose sight of that. But our justice system requires the State to prove its case beyond a reasonable doubt.

The jury heard the evidence. The jury did its job.
NOT GUILTY.
