People do not come to us when life is good. They come when it is genuinely hard.

And that means the person sitting across from us is already carrying a lot before the conversation even starts. So the last thing they need is to feel like a number or like their situation is less important than someone else’s.

Everyone here gets the same attention. Same patience. Same honesty. Whether it is a straightforward case or the most complicated one we have seen all year.

That is just how this place works. 😌

Divorce brings a lot of change, and one of the most important areas to slow down and review carefully is your financial situation. Before decisions are made, it helps to understand exactly what you have, what you owe, and what your day-to-day reality will look like moving forward.

Start with joint bank accounts. Look at how money has been used, what deposits and withdrawals have been made, and whether any accounts need to be separated or documented.

Next, take a clear look at shared debts. Credit cards, loans, or any obligations in both names still matter, even if one person was primarily responsible for them during the marriage.

Then review property ownership. This includes real estate, vehicles, and any other assets. Understanding how things are titled helps clarify what is considered shared and what may be separate.

It’s also important to look at your monthly expenses. What does it actually cost to maintain your lifestyle? This step helps you prepare for post-divorce budgeting and planning in a realistic way.

Lastly, review insurance policies. Health, life, home, or auto coverage may need to be updated depending on how your situation is changing.

Taking time to go through these details carefully can make a significant difference in how your case is handled and how prepared you feel for what comes next. Clear information leads to better decisions.

Utah law does not have a minimum marriage length to qualify for alimony. There is no magic number. But the length of the marriage is one of the most important factors a judge weighs when deciding whether to award it and for how long.

Here is how it generally breaks down in Utah courts....

Under 5 years.... you are unlikely to get long term alimony. The court may award short term transitional support to help you get back on your feet but that is usually it.

5 to 8 years.... this is where it gets interesting. Courts have gone both ways here. In one Utah Supreme Court case a seven year marriage got no alimony. But in 2021 an eight year marriage was awarded alimony for the full eight years. It really comes down to the specific circumstances.

10 years or more.... this is where things shift significantly. The 2024 HB 220 reforms introduced a presumption that courts should equalize the standard of living for marriages lasting 10 or more years where one spouse reduced their workplace experience to care for children.

And the cap? Under Utah Code alimony generally cannot last longer than the length of the marriage itself. Married for six years? Maximum six years of alimony.

Short marriage does not automatically mean zero. But it does mean the bar is higher and the case you build matters a lot more.

Kids absorb more than we give them credit for. What feels like venting in the moment sticks with them longer than you think. It molds how they process the divorce, how they feel about both parents, and honestly how they feel about themselves in the middle of it.

There is also a practical side to this. Courts look at how each parent supports the child’s relationship with the other parent when making custody decisions. Consistently putting the other parent down in front of the kids is something judges notice. It has changed outcomes.

It is hard to hold that standard when you are hurt. But the kids are not the right audience for that pain.

They just need to know both their parents still show up for them.

What happens when Dad is the custodial parent and Mom is not working? Does she still owe child support? 👇

Let us clear this up because this myth costs people a LOT.

Child support is not gendered. AT ALL.

It is calculated based on income, parenting time, and the financial needs of the child. Either parent can owe it. Either parent can receive it. The law does not care which parent is which.

So does Mom owe child support if she is not working?

Possibly yes. And here is why.

Courts do not just look at what someone is currently earning. They look at what someone is CAPABLE of earning. This is called imputed income. If a court determines that Mom is voluntarily unemployed or deliberately earning less than her actual capacity.... child support gets calculated based on what she could be making. Not what she is making.

What if she genuinely cannot work?

That is a different conversation. Documented disability. Medical reasons. Real barriers to employment. Courts consider all of that. But “”I am not working right now”” on its own is not a legal shield from child support obligations.

What does Dad need to do?

Document everything. Keep records of parenting time. Track expenses for the child. And if Mom is avoiding work to avoid child support.... bring that pattern to your attorney with evidence. Courts have seen this move before and they have the tools to address it.

The custody arrangement does not determine who owes support. The financial picture does. 😌

We are going to need everyone to sit with that take for a second.

Because as family law attorneys we can tell you EXACTLY where that mindset ends up. In a custody hearing. Where one parent has documented years of active involvement in their child’s daily care and the other does not.

Guess which one the court looks more favorably on.

Diaper changes. Nighttime feeds. Doctor appointments. School pickups. Bedtime routines. None of it is gendered. All of it is PARENTING. And all of it gets considered when a judge is deciding who the primary caregiver actually is.

The dad who said “that is not my job” during the marriage is the same dad who shows up to court saying he deserves 50/50.

And the judge has a record of everything. 😌

Can you take legal action against parental manipulation? YES. And here is exactly what that looks like. 👇

Parental manipulation is one of the most painful things a parent can go through. Your ex badmouthing you to your child. Blocking calls. Turning them against you. Making them feel like they have to choose a side.

And most people going through it feel completely powerless.

You are NOT powerless.

Courts take parental manipulation seriously because it directly harms the CHILD. Not just you. And that is the angle that actually moves a judge.

Here is what legal action can look like....

Custody modification. Documented parental manipulation can flip the entire custody arrangement. The child comes to live primarily with you.

Contempt of court. Withholding visitation. Blocking contact. Violating a court order. That is contempt. Fines. Community service. In serious cases jail time.

Supervised visitation. The manipulating parent loses unsupervised access until the behavior stops.

Court ordered therapy. For both the child and the parent doing the manipulating.

But here is what makes ALL of this possible.... documentation. Every ignored call. Every blocked visit. Every instance of manipulation. Dated. Saved. In writing.

Courts respond to patterns. Not feelings. Build the record before you need it.

If this is happening to you right now do not wait. 👇
