It is absolutely possible for a parent who was never been involved in a child’s life to obtain custody. In these cases, courts deliberate upon factors surrounding a child’s best interest. For instance, courts can consider the reason for prior abandonment of the child, the length of time a parent has been estranged, and the state of both parents’ living situations. Factors like these and many others go into a court's childcustody decision.

In Utah, the laws require an equitable division of all marital property. Equitable means that the division of property is fair, not necessarily equal.

If the parties agree how to divide their property, the judge will review the agreement to be sure that it is fair.

When deciding what is a fair distribution the judge will look at several factors such as, the length of the marriage, the age and health of the parties, their occupations, the amounts and sources of income.

For long-term marriages, equitable may be a 50-50 split, or the judge may decide that it is fair to give one party more or less than 50% of the marital estate.

In short term marriages, the court decision may be to return the parties back to their economic position before the marriage.

What does it mean when someone says they got an annulment? It means they went to court and dissolved their marriage. In the eyes of the law, the parties were never married. The judge declares the marriage void as though it never took place. Annulments are only available under certain limited circumstances. If you go to mediation , you can work on a mutually beneficial solution. In court, the judge will make the decision for you based on information provided by both parties and divide assets acquired during the marriage with consideration given to the circumstances of the divorce and how the assets were acquired. You may not always like the outcome, so mediation can be really beneficial.
