For a commercial driver operating a personal, non-commercial vehicle, the legal blood alcohol concentration (BAC) limit is 0.08% in most states, matching the standard limit for regular adult motorists.

However, a critical distinction applies to commercial driver's license (CDL) holders:

In a personal vehicle: You are generally subject to the standard 0.08% BAC limit for a DUI under state law.

In a commercial vehicle: The strict 0.04% limit applies.

The CDL Disqualification Risk: Even though the driving limit is 0.08% in your personal car, a DUI conviction in your personal vehicle will still result in the disqualification/suspension of your CDL (typically for 1 year for a first offense). Furthermore, restricted or hardship CDLs are not available to let you drive commercially during a suspension period.

State Variations: Some states enforce the lower 0.04% limit for CDL holders even when driving personal vehicles, so local state statutes may vary.

Everyone makes mistakes. But how many is too many?

Under California's AB 1546, signed into law by Governor Gavin Newsom, a third DUI conviction within a 10-year period becomes a "wobbler" starting January 1, 2027. This means prosecutors can choose to charge a third DUI as either a misdemeanor or a felony, rather than strictly a misdemeanor.

Post-driving alcohol consumption is a close second. Not that I recommend it.
