DISCHARGE UPGRADE NEWS
We are pleased to report a positive development for Veterans with Discharge Upgrade cases/requests. In a class action lawsuit of Manker v. Del Toro decided on February 15, 2022, the Federal Court for the District of Connecticut approved a class action settlement for all Veterans that have previously filed and been denied discharge upgrades since 2001. This settlement will affect future cases as well. Happy New Year to all our clients, Veterans and Active Duty Service Members. 2021 was a great year for Military Disability Lawyer, LLC. - Law Office of Luke D. Miller as we expanded by adding another attorney to our office (Attorney Rick Bradley) to help serve more Veterans and their family members. Another successful week representing a client at a military Physical Evaluation Board (PEB). The military proposed medically separating the service member, resulting in a tax free loan and no long-term benefits to the service member. We successfully appealed and the service member will now be permanently medically retired, ensuring a pension and healthcare benefits for life!

This week we argued Van Dermark v. Wilkie in front of a three judge panel at the Court of Appeals for Veterans Claims. For those unfamiliar with this case, it seeks to establish a right to reimbursement for emergency medical treatment rendered in a foreign location pursuant to 38 U.S.C. 1725 and 1728. This case carries significant implications for Veterans. Now, we patiently wait for the Court's decision.

We've expanded to serve more Veterans! Rick Bradley, an amazing person and attorney, has joined our firm as an attorney. Previously, Rick (Top) and I served together in the Marines. Rick was a senior enlisted while I was a young officer. After retiring from the Marines we both attended and graduated from different law schools, while maintaining a close personal relationship. Rick has spent the last year working for the firm as a paralegal, even after he previously passed the bar exam. Rick recently completed his licensure as an attorney, is now admitted in the District of Columbia (soon to be Washington State as well), and has been admitted to practice at the Court of Appeals for Veterans Claims (CAVC). We are beyond thrilled to have him on board and he's hitting the ground running. Expanding our firm allows us to represent more Veterans and their family members.
