We secured another dismissal for our client! In this case, the alleged victim did not disclose all the facts around the crime she accused our client of. When we presented those to the state, the prosecutor dismissed.

As a former prosecutor and as a defense attorney, I’ve handled thousands of DWI cases over 25 years, but it’s important to stay abreast of changes and best practices in the law. Last month I flew out to Denver to qualify as an SFST (Standardized Field Sobriety Test) administrator. This is the same NHTSA training law enforcement has to pass in order to administer roadside tests to drivers. Not only am I certified, I got a 100% on the end of course exam. Lesch Law Firm is on a roll! Last week we shared with you our dismissal of charges in a Dakota County criminal case. This week we got word that we won at the Minnesota Court of Appeals. It’s said that the best way to win at the Court of Appeals is to win at the District Court. And while that is usually true (a MN district court decision is not reversed or remanded in 84% of cases), a good advocate can sometimes beat the odds. Crime television shows are popular. Some law enforcement agencies or individuals lead the public to believe that unvalidated, junk science procedures are enough to convict someone of a crime, and TV shows like CSI have sometimes echo these falsehoods. Even worse is when technology is used to suggest that they got the bad guy but they just did poor police work. In this case, law enforcement got sloppy and Angela Lipps had to spent 5 months in custody for their mistake.

Sometimes when a person is charged with a crime, they know they're not guilty. They'll often ask me, "When will they dismiss it?" 99.9% of the time, that answer is, "never."
