Pleased to report that my first case to go to the new 6th District Court of Appeals resulted in a favorable "PCA" decision recently. The other side has not filed a timely motion for rehearing, written opinion, or the like, so my client's favorable Judgment will stand. And the 6th DCA affirmed/granted entitlement to both trial and appellate attorney's fees, so this was the best news in this case. 🎉

This firm argued an appellant who failed to object in an initial hearing could not revive the waived objection by making it in a subsequent hearing, requesting the court reaffirm the original order in a new order, and then appealing that new order. Today, the Fifth District Court of Appeal agreed with us, dismissing the appeal for lack of jurisdiction and citing authority from our brief for the principle that "repetition of prior ruling in later order does not operate to resurrect untimely appeal as to prior ruling." Congratulations to our client!

The courthouses remain open virtually! In fact, judges are encouraging litigants to schedule virtual hearings because trials are canceled and their calendars are open.

Wondering what appeals even are? Here is a useful graphic from the Florida Supreme Court.

Visitors to the Florida Supreme Court are sometimes surprised to learn that the Court doesn't retry cases decided in trials at local courts. On appeal, Florida's appellate courts focus on matters of law instead and other serious errors. This graphic explains the difference between trial and appellate courts. Tune in throughout the year to watch Florida Supreme Court arguments from start to finish on Facebook Live, an our web livestream, and on some cable TV channels in Florida. https://bit.ly/2P0ZdSb

"Appellate attorneys can elevate a trial team on numerous fronts. They are often strong brief writers who can boil down the essentials of a case and hone the legal arguments. They also can use their long-term perspective to help shape discovery proceedings."

Faced with bigger litigation threats, more companies are bringing appellate lawyers onto trial teams, laying the groundwork for appeals before they’re even filed — and sometimes doing away with the need for them altogether.
