Every case is unique, which is why understanding how the law applies to your situation is so important. Visit our FAQ page for answers to this and many other common questions about personal injury claims, medical malpractice claims, and more! https://rebrand.ly/ca38b0

No news is good news. Right?

You have an MRI, X-ray, CT scan or mammogram. Days pass. No phone call. No urgent message. No one tells you that you need another test.

So you assume everything is fine.

But what happens when it isn't?

Sometimes an abnormality is visible but overlooked. Sometimes it is seen but interpreted as benign. And sometimes the radiologist identifies a concerning finding—but the patient is never told or the recommended follow-up never happens.

Our latest blog examines radiology misreads and breakdowns in communicating abnormal imaging results, including a 2026 Florida case involving breast cancer that was diagnosed months after earlier imaging was reported as benign.

Because sometimes the most important question isn't simply “Did the radiologist miss it?”

It's “Who knew, what should have happened next—and why didn't the patient know?”

What happens before a medical malpractice case ever reaches litigation?

As Robert Travieso explains, viable medical malpractice cases require medical support from another physician who reviews the records and believes malpractice occurred.

That’s why understanding the process behind these cases matters when you hear claims about “frivolous” medical malpractice lawsuits.

Robert recently shared his experience with Jacksonville University’s Medical Malpractice Club, giving students insight into what actually goes into evaluating these cases.

What actually makes a medical malpractice case?

As Robert Travieso explains, think of it like a three-legged stool. For a potential claim to stand, three key elements need to be strong:

⚖️ Liability — Did a healthcare provider make a negligent error?

🔗 Causation — Did that error actually cause the patient’s injury, harm, or death?

📋 Damages — What harm resulted, and what damages could potentially be awarded for those losses?

Not every medical error automatically results in a viable medical malpractice claim. Evaluating how these three elements fit together is an important part of determining whether a case can be successfully pursued.

🎒 Back-to-School Safety Trivia Time! 🚸

With students heading back to the classroom, school zones are once again a part of the daily commute.

🤔 Comment your guess below before swiping to reveal the answer.

School zones are designed to give drivers more time to react to children, crossing guards, buses, and increased pedestrian traffic. Slowing down and staying alert can make an important difference in keeping students safe.

Signing a consent form doesn’t always mean you were truly informed.

Before undergoing a medical procedure, patients generally expect their doctor to explain what’s being recommended, the potential risks, and other information they need to make an informed decision about their care.

But what happens when a doctor doesn’t tell you enough?

Some professional relationships are built over years. Others are forged in the courtroom.

For Robert Travieso, going through trial alongside Mac McLeod revealed just how closely their philosophies aligned.

“Each day in trial is worth a year or two working with that person.”

The long days, difficult decisions, preparation, and pressure of trial have a way of showing you exactly how someone thinks and approaches the responsibility of representing a client.

For Robert and Mac, it became clear they shared the same philosophy toward their work—and ultimately, it was a perfect meeting of the minds.
